641.711 Ordinance of 30 November 2012 for the Reduction of CO2 Emissions (CO2 Ordinance)

Art. 12

1 Gli attestati per le riduzioni delle emissioni conseguite in Svizzera nel periodo 2013–2021 sono rilasciati, su domanda, ai gestori con impegno di riduzione secondo l’articolo 66 capoverso 1, per i quali vige un obiettivo di emissione secondo l’articolo 67, e che non conducono progetti o programmi secondo gli articoli 5 o 5a le cui riduzioni delle emissioni sono computate nell’obiettivo di riduzione, se:25

a.
il gestore dimostra in modo credibile che raggiungerà il suo obiettivo di emissione senza computare i certificati di riduzione delle emissioni;
b.26
rispetto al percorso di riduzione di cui all’articolo 67, nell’anno in questione le emissioni di gas serra degli impianti sono state:
1.
inferiori di oltre il 5 per cento nel periodo 2013–2020,
2.
inferiori di oltre il 10 per cento nel 2021; e
c.
non sono stati versati né prestazioni in denaro non rimborsabili di Confederazione, Cantoni o Comuni volte a promuovere le energie rinnovabili, l’efficienza energetica o la protezione del clima, né fondi ottenuti dal supplemento di cui all’articolo 35 LEne27 per geotermia, biomassa e scorie da biomassa; ne sono esclusi i gestori che si erano annunciati per ricevere tali fondi già prima dell’entrata in vigore della modifica dell’8 ottobre 201428.29

1bis La domanda di rilascio degli attestati deve essere presentata all’UFAM entro il 31 dicembre 2023.30

2 Gli attestati sono rilasciati per riduzioni delle emissioni pari alla differenza tra il percorso di riduzione dedotta la percentuale determinante di cui al capoverso 1 lettera b e le emissioni di gas serra nel corso dell’anno interessato, e ciò per l’ultima volta nel 2021.31

Art. 12

1 Installation operators with reduction obligations under Article 66 paragraph 1 to which an emission target under Article 67 applies and which are not carrying out any projects or programmes in accordance with Article 5 or 5a that result in emission reductions covered by the emissions target shall on application be issued with attestations for domestic emission reductions for the years 2013–2021 if:25

a.
the installation operator credibly reports that its emissions target will be reached without counting emission-reduction certificates;
b.26
the installation’s greenhouse gas emissions in the relevant year have been reduced when compared with the reduction course determined in accordance with Article 67 by the following percentages:
1.
from 2013–2020: by more than 5 per cent,
2.
in 2021: by more than 10 per cent; and
c.
for emission-reduction measures, the installation operator has received no non-refundable payments from the Confederation, cantons or communes for promoting renewable energies, energy efficiency or climate protection or from surcharges obtained in accordance with Article 35 EnA27 for geothermal power, biomass and waste from biomass; excepted from this are installation operators that had already registered for the receipt of such funds before the amendment of 8 October 201428 came into force.29

1bis The application for the issue of attestations must be submitted to the FOEN by 31 December 2023.30

2 Attestations are issued for emission reductions to the extent of the difference between the reduction course under deduction of the relevant percentage under paragraph 1 letter b and the greenhouse gas emissions in the relevant year, for the last time in 2020.31
