Art. 31a Collaboration

1 Les cantons collaborent en matière de planification de la gestion des déchets ainsi qu’en matière d’élimination. Ils évitent les surcapacités en installations d’élimination des déchets.

2 S’ils ne parviennent pas à se mettre d’accord, ils proposent des solutions à la Confédération. Si la médiation de la Confédération ne permet pas d’aboutir à un accord, le Conseil fédéral peut ordonner aux cantons:

a.
de définir pour les installations de traitement, de valorisation ou de stockage définitif des zones d’apport des déchets; devront dès lors être remis à une installation donnée les déchets produits dans la zone d’apport correspondante;
b.
d’arrêter des emplacements pour la construction d’installations d’élimination des déchets;
c.
de mettre à la disposition d’autres cantons des installations d’élimination des déchets appropriées; le cas échéant, il règle la répartition des frais.

Art. 31a Cooperation

1 The cantons cooperate on waste management and disposal. They avoid over-capacity in waste disposal facilities.

2 If they cannot agree, they must submit proposed solutions to the Confederation. If mediation by the Confederation does not lead to agreement, the Federal Council may order the cantons:

a.
to determine the areas from which waste must be delivered to the installations for treatment, recovery or deposit in landfills (catchment areas);
b.
to determine sites for waste disposal facilities;
c.
to make suitable waste disposal facilities available to other cantons; where necessary, it determines how costs are to be shared.
