Art. 18 International business

¹The notification which a financial institution is required to submit to FINMA before engaging in activities abroad must contain all the information and documents needed to assess such activities, specifically:

a.: a business plan describing in particular the nature of the planned transactions and the organisational structure;
b.: the name and address of the office abroad;
c.: the names of the persons responsible for administration and management;
d.: the auditing firm;
e.: the name and address of the supervisory authority in the foreign state in which the registered office or domicile is located.

²Furthermore, the financial institution shall notify FINMA of:

a.: the discontinuation of business activities abroad;
b.: any material change in business activities abroad;
c.: a change in audit firm;
d.: a change in the supervisory authority in the foreign state in which the registered office or domicile is located.

Art. 18 Attività all’estero

¹ La comunicazione che l’istituto finanziario deve trasmettere alla FINMA prima di avviare la propria attività all’estero deve contenere tutte le indicazioni e i documenti necessari alla valutazione dell’attività, in particolare:

a.: un piano d’attività che descriva segnatamente il tipo di operazioni previste e la struttura organizzativa;
b.: il nome e l’indirizzo della sede all’estero;
c.: il nome delle persone incaricate dell’amministrazione e della gestione;
d.: la società di audit;
e.: il nome e l’indirizzo dell’autorità di vigilanza dello Stato estero di sede o di domicilio.

² L’istituto finanziario deve inoltre comunicare alla FINMA:

a.: la cessazione dell’attività all’estero;
b.: ogni importante modifica dell’attività all’estero;
c.: il cambiamento della società di audit;
d.: il cambiamento dell’autorità di vigilanza dello Stato estero di sede o di domicilio.
