Art. 117 Object

(Art. 98 para. 1 CISA)

1 The limited partnership for collective investment may only manage its own investments. It is specifically prohibited from rendering services pursuant to Article 26 and 34 FinIA170 t on behalf of third parties or taking up entrepreneurial activities for the pursuit of commercial purposes.171

2 It invests in risk capital of companies and projects and can determine their strategic direction. It can also invest in instruments pursuant to Article 121.

3 To achieve this object, it may:

a.
take control of voting rights in companies;
b.
sit on the body responsible for the governance, supervision and control of its participations, in order to safeguard the interests of the limited partners.

Art. 117 Scopo

(art. 98 cpv. 1 LICol)

1 La società in accomandita per investimenti collettivi di capitale può gestire esclusivamente il proprio patrimonio. Le è segnatamente vietato fornire a terzi prestazioni di servizi ai sensi degli articoli 26 e 34 LIsFi173 o avviare attività imprenditoriali a scopo commerciale.174

2 Essa investe in capitale di rischio di imprese e progetti e può determinarne l’orientamento strategico. Può anche investire in investimenti di cui all’articolo 121.

3 A questo scopo essa può:

a.
riprendere il controllo dei diritti di voto in imprese;
b.
per tutelare gli interessi degli accomandanti, far parte dell’organo della direzione superiore, della vigilanza e del controllo delle loro partecipazioni.
