1 If immediate safety and protective measures have to be taken during the conduct of a clinical trial, the investigator shall notify the ethics committee of these measures, and of the circumstances necessitating them, within 7 days.
2 In the case of clinical trials of products under Article 2a paragraph 2 TPA, this notification shall be made within 2 days.
3 For Category B and C clinical trials, the notifications specified in paragraphs 1 and 2 shall be made to the Agency. This obligation rests on the sponsor.
1 L’investigateur déclare à la commission d’éthique dans les sept jours les mesures de sécurité et de protection qui doivent être prises immédiatement pendant la réalisation d’un essai clinique ainsi que les circonstances qui ont rendu ces mesures nécessaires.
2 Pour les essais cliniques de dispositifs au sens de l’art. 2a, al. 2, LPTh, la déclaration est à remettre dans les deux jours.
3 Pour les essais cliniques de catégories B et C, les déclarations au sens des al. 1 et 2 sont effectuées auprès de l’institut. Cette obligation incombe au promoteur.
