121 Federal Act of 25 September 2015 on the Intelligence Service (Intelligence Service Act, IntelSA)

Art. 51 INDEX SIC

1 Il sistem d’infurmaziun INDEX SIC serva:

a.
a constatar, sch’il SIC elavura datas davart ina persuna, in’organisaziun, ina gruppaziun, in object u in eveniment;
b.
ad archivar ils rapports che las autoritads executivas chantunalas han fatg;
c.
ad elavurar datas da scleriments preliminars da las autoritads executivas chantunalas.

2 El permetta a las autoritads che n’èn betg colliadas cun la rait spezialmain segira dal SIC l’access a las datas ch’ellas dovran per ademplir lur incumbensas legalas e la transmissiun segira da quellas.

3 El cuntegna:

a.
las datas per identifitgar las persunas, las organisaziuns, las gruppaziuns, ils objects ed ils eveniments ch’èn registrads en ils sistems d’infurmaziun IASA SIC ed IASA-GEX SIC;
b.
ils rapports che las autoritads executivas chantunalas han fatg autonomamain u per incumbensa dal SIC;
c.
las datas da scleriments preliminars da las autoritads executivas chantunalas.

4 Las suandantas persunas han en la procedura d’invista access a las suandantas datas en INDEX SIC:

a.
ils collavuraturs dal SIC a las datas tenor l’alinea 3 literas a e b, sch’els èn incumbensads da scuvrir a temp e d’impedir smanatschas per la Svizra e per sia populaziun;
b.
ils collavuraturs da las autoritads executivas chantunalas per ademplir lur incumbensas tenor questa lescha sco er per elavurar e per transmetter lur datas da scleriments preliminars e lur rapports al SIC ed ad autras autoritads executivas chantunalas; access a las datas tenor l’alinea 3 litera c han exclusivamain ils collavuraturs da l’autoritad executiva chantunala che ha fatg ils scleriments preliminars sco er ils collavuraturs dal post per la garanzia da qualitad dal SIC;
c.
ils collavuraturs da l’Uffizi federal da polizia a las datas tenor l’alinea 3 litera a per ademplir incumbensas da la polizia da segirezza, da la polizia criminala e da la polizia administrativa sco er per examinar cas da suspect da lavada da daners suspectus e da finanziaziun da terrorissem en cas d’annunzias d’instituts da finanzas svizzers;
d.
ils collavuraturs dal post da servetsch dal DDPS, ch’è cumpetent per la segirezza da las infurmaziuns e dals objects, a las datas tenor l’alinea 3 litera a per far controllas da segirezza relativas a persunas.

Art. 51 INDEX FIS

1 The INDEX FIS information system is used:

a.
to establish whether the FIS is processing data relating to a person, an organisation, a group, an object or an event;
b.
to store reports prepared by the cantonal executive authorities;
c.
to process data from preliminary investigations carried out by the cantonal executive authorities.

2 It enables authorities that are not connected to the specially secured FIS network to access data that they need to fulfil their statutory tasks, and the secure transmission of such data.

3 It contains:

a.
data for the identification of the persons, organisations, groups, objects and events recorded in the IASA FIS and IASA-GEX FIS information systems;
b.
the reports prepared by the cantonal executive authorities independently or on behalf of the FIS;
c.
data from preliminary investigations carried out by the cantonal executive authorities.

4 The following persons have online access to the following data in INDEX FIS:

a.
FIS employees have access to the data in paragraph 3 letters a and b, provided they have the task of ensuring the early recognition and prevention of threats to Switzerland and its population;
b.
employees of the cantonal executive authorities in order to carry out their tasks in terms of this Act and to process and pass on their data from preliminary investigations and their reports to the FIS and to other cantonal executive authorities; only employees of the cantonal executive authority that carried out the preliminary investigations and the employees of the FIS quality assurance service have access to data in accordance with paragraph 3 letter c;
c.
employees of the Federal Office of Police have access to the data in accordance with paragraph 3 letter a in order to conduct security-related, criminal investigation and administrative-policing tasks and to assess allegations of money laundering and terrorism financing contained in reports from Swiss financial institutions;
d.
the employees of the DDPS Information Security and Facility Protection Unit have access to the data in accordance with paragraph 3 letter a in order to carry out personnel security screening procedures.
