¹ L’autorità valuta se le acque di scarico immesse nelle acque o lasciate infiltrare vadano considerate inquinate o non inquinate, secondo:

a.: il tipo, la quantità e le caratteristiche delle sostanze presenti nelle acque di scarico e suscettibili di inquinare acque, nonché il periodo durante il quale tali sostanze vengono immesse;
b.: lo stato delle acque nelle quali pervengono le acque di scarico.

² Se le acque di scarico vengono lasciate infiltrare, l’autorità considera anche se:

a.: le acque di scarico possano essere inquinate a causa del deterioramento presente nel suolo o nella zona insatura del sottosuolo;
b.⁴: le acque di scarico vengano sufficientemente depurate nel suolo;
c.: i valori indicativi fissati dall’ordinanza del 1° luglio 1998⁵ contro il deterioramento del suolo (Osuolo) possano essere rispettati a lungo termine, fatta eccezione per l’infiltrazione in un impianto apposito o nella zona delle scarpate e delle fasce verdi lungo le vie di comunicazione.

³ In linea di principio, l’acqua piovana che scorre da superfici edificate o rinforzate va considerata acqua di scarico non inquinata se proviene:

a.: da tetti;
b.⁶: da strade, sentieri e piazzali sui quali non vengono scaricate, lavorate e depositate ingenti quantità di sostanze suscettibili di inquinare le acque e, in caso di infiltrazione, se viene sufficientemente depurata nel suolo; nel valutare se le quantità di sostanze siano ingenti, bisogna tenere conto del rischio di incidenti;
c.⁷: da strade ferrate per le quali è garantito che si rinuncerà a lungo termine all’impiego di prodotti fitosanitari o, in caso di infiltrazione, se i prodotti fitosanitari sono sufficientemente trattenuti e degradati da uno strato di terreno biologicamente attivo.

Art. 3

¹ The authorities shall assess whether waste water entering a body of water by way of discharge or infiltration is considered to be polluted or non-polluted, taking account of:

a.: the type, the amount, the characteristics and the temporal occurrence of potential water pollutants substances in the waste water;
b.: the condition of the receiving waters.

² During infiltration of waste water, they shall also take account of whether:

a.: waste water can be polluted because of existing soil pollution or the unsaturated subsoil;
b.⁴: waste water is sufficiently purified in the soil or in the unsaturated subsoil;
c.: guide values under the Ordinance of 1 July 1998⁵ on the Pollution of Soil (SoilPO) can be maintained in the long term, excepting infiltration into a plant intended for this purpose, or onto roads next to embankments or grass verges.

³ Precipitation water running off built-up or sealed surfaces is as a rule considered to be non-polluted waste water if it:

a.: originates from roof surfaces;
b.⁶: originates from roads, paths and areas on which no substantial amounts of potential water pollutants are unloaded, processed and stored and if they are sufficiently purified by infiltration into the ground. In assessing whether amounts of substances are substantial, the risk of accidents must be taken into consideration;
c.⁷: originates from track installations where there is a long-term guarantee that pesticides will not be used or if pesticides have been sufficiently retained and degraded by a biologically active layer of soil.
