Il Consiglio federale svizzero,
visti gli articoli 15a capoversi 1 e 5, 15b capoverso 6, 15c e 95 della legge federale del 20 dicembre 19571 sulle ferrovie (Lferr);
visto l’articolo 12 capoverso 1 della legge federale del 5 ottobre 19902 sui binari di raccordo ferroviario;
visto l’articolo 5 capoverso 2 della legge federale del 23 settembre 19533 sulla navigazione marittima sotto bandiera svizzera;
visti gli articoli 25 capoversi 1 e 5, 26 capoverso 6 e 26a capoverso 1 della legge federale del 21 dicembre 19484 sulla navigazione aerea (LNA);
in esecuzione del regolamento (UE) n. 996/20105 nella versione vincolante per la Svizzera in virtù del numero 3 dell’allegato all’Accordo del 21 giugno 19996 tra la Confederazione Svizzera e la Comunità europea sul trasporto aereo;
e in esecuzione della direttiva 2004/49/CE7 nella versione vincolante per la Svizzera in virtù dell’allegato 1 all’Accordo del 21 giugno 19998 tra la Confederazione Svizzera e la Comunità europea sul trasporto di merci e di passeggeri su strada e
per ferrovia,
ordina:

The Swiss Federal Council,
on the basis of Articles 15a paragraphs 1 and 5, 15b paragraph 6, 15c and 95
of the Railways Act from 20 December 19571 (RailA),
on Article 12 paragraph 1 of the Federal Act of 5 October 19902 on Private Sidings,
on Article 5 paragraph 2 of the Navigation Act of 23 September 19533
and on Articles 25 paragraphs 1 and 5, 26 paragraph 6 and 26a paragraph 1
of the Civil Aviation Act of 21 December 19484 (CAA),
in implementation of Regulation (EU) No 996/20105 in the version binding on Switzerland in accordance with number 3 of the Annex to the Agreement of
21 June 19996 between the Swiss Confederation and the European Union on Air Transport
and Directive 2004/49/EC7 in the version currently binding on Switzerland in accordance with Annex 1 to the Agreement of 21 June 19998 between the Swiss Confederation and the European Union on the carriage of goods and passengers by rail and road,
ordains:
