Art. 15 Denominazione e attività dell’organismo di certificazione

1 Chiunque utilizzi una denominazione d’origine svizzera o un’indicazione geografica svizzera registrata conformemente alla presente ordinanza deve affidare a uno o più organismi di certificazione definiti nell’elenco degli obblighi il controllo della conformità dei suoi prodotti.

2 Gli organismi di certificazione devono essere accreditati conformemente all’ordinanza del 17 giugno 19966 sull’accreditamento e sulla designazione per ogni denominazione di cui effettuano la certificazione.

3 Le procedure di controllo sono definite in un manuale elaborato per ogni denominazione dall’organismo o dagli organismi di certificazione.

4 Il manuale di controllo applicabile a ciascuna denominazione registrata è depositato presso l’IPI.

5 L’organismo o gli organismi di certificazione fornisce o forniscono annualmente all’IPI un rapporto per ogni denominazione registrata. Vi figurano segnatamente:

a.
la lista delle imprese controllate;
b.
la quantità di prodotti commercializzati con la denominazione registrata;
c.
il numero e il genere dei provvedimenti correttivi e il numero dei ritiri di certificati.

6 Gli organismi di certificazione notificano all’IPI, ai Cantoni interessati e al raggruppamento le maggiori irregolarità constatate in occasione dei controlli.

Art. 15 Designation and activities of the certification body

1 Any person who uses a Swiss appellation of origin or a Swiss geographical indication registered in accordance with this Ordinance must entrust one or more certification bodies listed in the product specification with checking the conformity of their products.

2 The certification bodies must be accredited for each denomination that they certify in accordance with the Accreditation and Designation Ordinance of 17 June 19966.

3 For each denomination, they shall create a manual in which the control procedures are specified.

4 The control manual applicable for each registered denomination shall be filed with the IPI.

5 The certification bodies shall submit an annual report to the IPI for each registered denomination. This shall include the following information, in particular:

a.
the list of the businesses it controls;
b.
the number of products marketed with the registered denomination;
c.
the number and type of corrective actions and the number of certificates withdrawn.

6 The certification bodies shall notify the IPI, the relevant cantons and the group of producers of the principal irregularities identified during the controls.
