1 Se l’ufficio doganale trattiene prodotti, ne assume la custodia dietro pagamento di una tassa oppure li affida a terzi, a spese del richiedente.
2 L’Ufficio doganale comunica al richiedente il nome e l’indirizzo del depositante, del detentore o del proprietario, una descrizione precisa, la quantità e il nome del mittente in Svizzera o all’estero della merce ritenuta.29
3 Qualora fosse stabilito già prima della scadenza del termine previsto all’articolo 77 capoversi 2 e 2bis 30 LDA che al richiedente non è concesso ottenere provvedimenti cautelari, i prodotti sono sbloccati immediatamente.31

1 If the customs office withholds goods, it shall retain the goods for a fee or shall place them in the custody of a third party at the cost of the applicant.28
2 It shall provide the applicant with the name and address of the declarant, holder or owner, a precise description, and details of the quantity and the sender of the goods withheld in Switzerland or abroad.29
3 If it is established prior to the expiry of the time limit under Article 77 paragraph 2 or paragraph 2bis 30 CopA that the applicant will be unable to obtain preliminary measures, the goods shall be released immediately.31
