Art. 22 Procédure d’autorisation simplifiée

¹ Une procédure d’autorisation simplifiée peut être demandée pour les disséminations expérimentales réalisées avec des organismes génétiquement modifiés, des organismes pathogènes ou des petits invertébrés exotiques si:

a.: une autorisation a déjà été accordée en Suisse pour une dissémination expérimentale impliquant des dangers et des atteintes potentiels comparables, en particulier s’il s’agissait des mêmes organismes;
b.: les organismes concernés sont issus du croisement de deux organismes dont la mise en circulation à des fins d’utilisation directe dans l’environnement a déjà été autorisée et qu’il peut être démontré que la somme des propriétés du croisement ne se différencie pas de la somme des propriétés des organismes autorisés.

² Une demande de procédure d’autorisation simplifiée doit comprendre au moins les documents mentionnés aux art. 19, al. 2, let. a, d, e et h, 20, al. 2, let. a, d, e et g, ou 21, al. 2, let. a, d et e.

Art. 22 Simplified licensing procedure

¹ The applicant may request a simplified licensing procedure for experimental releases of genetically modified organisms, pathogenic organisms or alien small invertebrates if:

a.: an experimental release with comparable possible hazards and harm has been authorised in Switzerland, in particular, if it involves the same organisms;
b.: these organisms originate from the crossing of two organisms that have already been authorised for marketing for direct use in the environment, and it can be shown that the sum of the properties of the crossing do not differ from the sum of the properties of the authorised organisms.
² For a simplified licensing procedure, at least the documents in accordance with Article 19 paragraph 2 letters a, d, e and h or in accordance with Article 20 paragraph 2 letters a, d, e and g or Article 21 paragraph 2 letters a, d and e must be submitted.
