Art. 4 Dons destinés à la recherche, à l’enseignement ou à l’infrastructure

Les dons au sens de l’art. 55, al. 2, let. b, LPTh faits à des organisations en faveur de la recherche, de l’enseignement ou de l’infrastructure sont admis pour autant qu’ils:

a.: ne soient pas proposés, promis ou octroyés au professionnel lui-même, mais à l’organisation qui l’emploie;
b.: se fondent sur une convention écrite indiquant l’utilisation prévue;
c.: soient exclusivement utilisés conformément à leur but;
d.: ne soient pas liés à des conditions ou à des charges relatives à la prescription, à la remise, à l’utilisation ou à l’achat de médicaments déterminés soumis à ordonnance;
e.: soient virés sur un compte prévu à cet effet par l’organisation, auquel les professionnels n’ont pas un accès individuel, et qu’ils
f.: figurent dans la comptabilité de l’organisation.

Art. 4 Support for research, teaching and infrastructure

Contributions that are permitted as support given to organisations for research, teaching and infrastructure in accordance with Article 55 paragraph 2 letter b TPA are contributions that:

a.: are not offered, promised or given to professional in person but to the organisation that employs the professional;
b.: are based on a written agreement which clearly states their intended purpose;
c.: are used exclusively for that intended purpose;
d.: are not subject to conditions or requirements that relate to the prescription, dispensing, use or purchase of certain prescription-only medicinal products;
e.: are credited to a specific account held by the organisation to which professionals do not have sole access; and
f.: are shown in the organisation’s accounts.
