Art. 80b Participation à la procédure et consultation du dossier

¹ Les ayants droit peuvent participer à la procédure et consulter le dossier si la sauvegarde de leurs intérêts l’exige.

² Les droits prévus à al. 1 ne peuvent être limités que si l’exigent:

a.: l’intérêt de la procédure conduite à l’étranger;
b.: la protection d’un intérêt juridique important, si l’État requérant le demande;
c.: la nature ou l’urgence des mesures à prendre;
d.: la protection d’intérêts privés importants;
e.: l’intérêt d’une procédure conduite en Suisse.

³ Le refus d’autoriser la consultation de pièces ou la participation à la procédure ne peut s’étendre qu’aux actes qu’il y a lieu de garder secrets.

Art. 80b Participation in the proceedings and access to the files

¹ The persons entitled may participate in the proceedings and have access to the files provided this is necessary to safeguard their interests.

² The rights provided for in paragraph 1 may be limited only:

a.: in the interest of the foreign proceedings;
b.: for the protection of an important legal interest if the requesting State so requests;
c.: because of the nature or urgency of the measures to be taken;
d.: for the protection of important private interests;
e.: in the interest of Swiss proceedings.

³ Access to the files or participation in the proceedings may only be denied in the case of files or procedural measures for reasons of confidentiality.
