Art. 15 Consultation without the client being physically present

(Art. 9 para. 2 and 63 let. c FinSA)

1 Consultation is deemed to take place without the client being physically present within the meaning of Article 9 paragraph 2 FinSA if:

a.
the parties are not at the same location; and
b.
on account of the communication medium used, it is not feasible with a reasonable amount of effort to make the key information document available to the retail client before the signing or conclusion of the contract.

2 In the case of consultation without the client being physically present, the retail client may generally consent to the key information document only being made available after conclusion of the transaction. This consent must be given in writing or in another form demonstrable via text separately from the consent given to the general terms and conditions.

3 Consent pursuant to paragraph 2 may be revoked in the same form at any time.

Art. 15 Consulenza fra assenti

(art. 9 cpv. 2 e 63 lett. c LSerFi)

1 Vi è una consulenza fra assenti ai sensi dell’articolo 9 capoverso 2 LSerFi se:

a.
le parti non si trovano nello stesso luogo; e
b.
a causa del mezzo di comunicazione utilizzato, non è possibile con un dispendio adeguato mettere a disposizione del cliente privato il foglio informativo di base prima della sottoscrizione o della conclusione del contratto.

2 Il cliente privato può acconsentire in maniera generale che, in caso di consulenza fra assenti, il foglio informativo di base sia messo a disposizione soltanto dopo la conclusione dell’operazione. Tale consenso deve essere dato separatamente rispetto a quello prestato per le condizioni generali, in forma scritta o in un’altra forma che ne consenta la prova per testo.

3 Il consenso di cui al capoverso 2 può essere revocato nella medesima forma in qualsiasi momento.
