Art. 43 Summary
1 The summary should facilitate a comparison with similar securities.
2 The summary must clearly state that:
- a.
- it is regarded as an introduction to the prospectus;
- b.
- the investment decision must be based not on the summary but on the information contained in the entire prospectus;
- c.
- liability for the summary is limited to cases where the information contained therein is misleading, inaccurate or inconsistent when read together with the other parts of the prospectus.
Art. 43 Nota di sintesi
1 La nota di sintesi ha lo scopo di facilitare il raffronto tra valori mobiliari analoghi.
2 Nella nota di sintesi è chiaramente evidenziato che:
- a.
- la stessa va intesa come introduzione al prospetto;
- b.
- la decisione di investimento non deve basarsi sulla nota di sintesi, bensì sulle indicazioni dell’intero prospetto;
- c.
- la responsabilità per le indicazioni contenute nella nota di sintesi sussiste soltanto nel caso in cui queste siano inesatte, suscettibili d’indurre in errore o contraddittorie rispetto alle altre parti del prospetto.
