Art. 9 Exemption from tax in cases of measures taken to reduce emissions

VOCs that are used in stationary installations in terms of Article 2 paragraph 1 and Annex 1 Number 32 of the Ordinance on Air Pollution Control of 16 December 198516 (OAPC) are exempt from the tax if:

a.
the measures taken have resulted in the annual quantity of VOC emissions from these installations being reduced by at least 50 per cent of the VOC emissions quantity allowed for the same rate of production while complying with the preventive emission limits set by Articles 3 and 4 of the OAPC;
b.
the air purification plant (APP) used therefor is in a good technical condition and is operational for 95 per cent of the operating time; and
c.
the VOC emissions of the stationary installation that are not processed by the APP (diffuse VOC emissions) are reduced in accordance with Annex 3.

Art. 9 Esenzione dalla tassa grazie a provvedimenti per ridurre le emissioni

I COV impiegati in un impianto stazionario ai sensi dell’articolo 2 capoverso 1 e l’allegato 1 numero 32 dell’ordinanza del 16 dicembre 198515 contro l’inquinamento atmosferico (OIAt) sono esenti dalla tassa se:

a.
la quantità delle emissioni annue di COV di detto impianto è stata ridotta, a seguito dell’adozione di provvedimenti, di almeno il 50 per cento rispetto alla quantità di COV che sarebbe stata emessa all’anno per la medesima produzione rispettando la quantità massima ammessa conformemente alla limitazione preventiva delle emissioni secondo gli articoli 3 e 4 OIAt;
b.
il dispositivo di abbattimento degli effluenti gassosi (dispositivo di abbattimento) impiegato a tal fine è tecnicamente in buono stato e disponibile durante il periodo d’esercizio al 95 per cento; e
c.
le emissioni di COV dell’impianto stazionario non evacuate mediante il dispositivo di abbattimento (emissioni diffuse di COV) sono ridotte secondo l’allegato 3.
