Art. 8 Period of validity

1 Authorisations in accordance with Article 7 and the placing on the market of biocidal products for which authorisation is not required (Art. 3 para. 3) are subject to a time limit. The following maximum periods of validity apply:57

a.
for authorisation AL:
1.
10 years, without prejudice to numbers 2–4,
2.58 5 years for biocidal products with an active substance which is a candidate for substitution, if a comparative assessment has been performed in accordance with Article 23 of Regulation (EU) No 528/201259,
3.
5 years for biocidal products with active substances authorised in accordance with Article 5 paragraph 2 of Regulation (EU) No 528/2012,
4.
4 years for biocidal products with an active substance which is a candidate for substitution, if no comparative assessment has been performed in accordance with Article 23 of Regulation (EU) No 528/2012;
b.
for authorisation AnL:
1.
4 years, or
2.
if earlier, until the following time:
–
until 3 years after the last active substance in the biocidal product has been listed in Annex 1 or 2, or
–
until the Notification Authority, having regard to the European Commission’s decision not to approve the active substance or include it in Annex I to Regulation (EU) No 528/2012, cancels the authorisation;
c.
for authorisations AN and AC:
1.
6 months after the last active substance in the biocidal product is listed in Annex 1 or 2,
2.
3 years after the last active substance in the biocidal product is listed in Annex 1 or 2, provided that the authorisation holder meets the requirements of Article 22 paragraph 2, or
3.
until the Notification Authority, having regard to the European Commission’s decision not to approve the active substance or include it in Annex I to Regulation (EU) No 528/2012, cancels the authorisation;
d.60
for derogations:61
1.
180 days for derogations under Article 30 paragraph 1 plus no more than 550 days if a requested extension is granted,
2.
3 years for derogations under Article 30a paragraph 1,
3.
for as long as necessary for derogations under Article 30b;
e.62
for recognition:
for as long as the authorisation of the reference product is valid;
f.
for recognition of a Union authorisation:

for as long as the Union authorisation is valid;

g.
for authorisation for parallel trade:
1.
for as long as the authorisation of the reference product is valid, or
2.
if the authorisation of the reference product is withdrawn at the request of the authorisation holder and the requirements specified in Article 11 are still met: until the date on which the authorisation for the reference product would normally have expired;
h.
for the placing on the market of a biocidal product authorised under a simplified procedure in an EU or EFTA Member State:

for as long as the authorisation is valid in the EU or EFTA Member State;

i.
for the placing on the market of a product within a biocidal product family:

for as long as the authorisation for the biocidal product family is valid;

j.
for release for purposes of research and development:

for the declared test duration;

k.63
for simplified authorisation:

10 years;

l.64
for the authorisation of the same biocidal products:
1.
– 10 years for authorisations based on an ordinary authorisation ZL,
–
5 years for authorisations based on an authorisation ZL with an active substance that is a candidate for substitution, or
–
4 years for authorisations based on an authorisation ZL with an active substance authorised under Article 5 paragraph 2 of Regulation (EU) 528/2012,
2.
10 years for biocidal products whose authorisation is based on a recognition or a recognition of a Union authorisation,
3.
for as long as the term of authorisation for the reference product applies for biocidal products whose authorisation is based on an authorisation ZN or ZB.

5 If the authorisation has expired, Article 26a governs any further placing on the market, supply to end consumers and the professional or commercial use of the biocidal product.66

Art. 8 Durata di validità

1 Le omologazioni secondo l’articolo 7 e l’immissione sul mercato di biocidi non soggetti all’obbligo di omologazione (art. 3 cpv. 3) sono limitate nel tempo. Vigono le seguenti durate massime:55

a.
per l’omologazione OE:
1.
10 anni fatti salvi i numeri 2–4,
2.56 5 anni per i biocidi con un principio attivo candidato alla sostituzione, se è stata effettuata una valutazione comparativa secondo l’articolo 23 del regolamento (UE) n. 528/201257,
3.
5 anni per i biocidi con principi attivi omologati secondo l’articolo 5 paragrafo 2 del regolamento (UE) n. 528/2012,
4.
4 anni per i biocidi con un principio attivo candidato alla sostituzione, se non è stata effettuata una valutazione comparativa secondo l’articolo 23 del regolamento (UE) n. 528/2012;
b.
per l’omologazione OnE:
1.
4 anni, oppure
2.
se avviene prima, fino alla seguente scadenza:
–
fino a 3 anni dopo l’iscrizione dell’ultimo principio attivo del biocida nell’elenco dell’allegato 1 o 2, oppure
–
finché l’organo di notifica non revochi l’omologazione sulla base della decisione della Commissione europea di non approvare il principio attivo o di non iscriverlo nell’allegato I del regolamento (UE) n. 528/2012;
c.
per le omologazioni ON e OC:
1.
6 mesi dopo l’iscrizione dell’ultimo principio attivo del biocida nell’elenco dell’allegato 1 o 2,
2.
3 anni dopo l’iscrizione dell’ultimo principio attivo del biocida nell’elenco dell’allegato 1 o 2, a condizione che il titolare dell’omologazione adempia le condizioni di cui all’articolo 22 capoverso 2, oppure
3.
finché l’organo di notifica non revochi l’omologazione sulla base della decisione della Commissione europea di non approvare il principio attivo o di non iscriverlo nell’allegato I del regolamento (UE) n. 528/2012;
d.58
per le deroghe ai requisiti:59
1.
180 giorni per le deroghe ai requisiti secondo l’articolo 30 capoverso 1, cui si aggiungono 550 giorni massimo se la proroga richiesta è accordata,
2.
3 anni per le deroghe ai requisiti secondo l’articolo 30a capoverso 1,
3.
il tempo necessario per le deroghe ai requisiti secondo l’articolo 30b;
e.60
per il riconoscimento

finché dura l’omologazione del prodotto di riferimento;

f.
per il riconoscimento di un’omologazione dell’Unione:

finché dura l’omologazione dell’Unione;

g.
per l’omologazione per il commercio parallelo:
1.
finché dura l’omologazione del prodotto di riferimento, oppure
2.
se l’omologazione del prodotto di riferimento è revocata su richiesta del titolare dell’omologazione e non sono ancora soddisfatti i requisiti di cui all’articolo 11: fino al giorno in cui sarebbe scaduta l’omologazione del prodotto di riferimento;
h.
per l’immissione sul mercato di un biocida omologato in uno Stato membro dell’UE o dell’AELS mediante la procedura semplificata:

finché dura l’omologazione nello Stato membro dell’UE o dell’AELS;

i.
per l’immissione sul mercato di un prodotto di una famiglia di biocidi:

finché dura l’omologazione della famiglia di biocidi;

j.
per l’emissione nell’ambiente a scopi di ricerca e sviluppo:

per la durata notificata della sperimentazione;

k.61
per l’omologazione semplificata:

10 anni;

l.62
per l’omologazione degli stessi biocidi:
1.
– 10 anni per le omologazioni basate su un’omologazione ordinaria OE
–
5 anni per le omologazioni basate su un’omologazione OE con un principio attivo candidato alla sostituzione
–
4 anni per le omologazioni basate su un’omologazione OE con un principio attivo omologato secondo l’articolo 5 paragrafo 2 del regolamento (UE) 528/2012,
2.
10 anni per i biocidi la cui omologazione è basata su un riconoscimento oppure su un riconoscimento di un’omologazione dell’Unione,
3.
finché dura l’omologazione per il prodotto di riferimento per i biocidi la cui omologazione è basata su un’omologazione ON o OC.

5 Se la durata di validità dell’omologazione del biocida è scaduta, la sua ulteriore immissione sul mercato, la sua consegna a consumatori finali e il suo uso a titolo professionale e commerciale sono retti dall’articolo 26a.64
