Art. 43 Mandatory authorisation

1 Any person who wishes to transplant organs, tissues or cells of animal origin or transplant products obtained therefrom into humans shall require authorisation from the FOPH.

2 Authorisation shall be granted for a clinical trial if:

a.
a risk of infection for the population can be excluded with a high degree of probability;
b.
a therapeutic benefit can be expected;
c.
the necessary technical and operative requirements have been fulfilled;
d.
a suitable quality assurance system is in place.

3 Authorisation shall be granted for standard treatment if:

a.
a risk of infection for the population can be excluded;
b.
a therapeutic benefit has been demonstrated;
c.
the requirements stipulated in paragraph 2 letters c and d have been fulfilled.

Art. 43 Obbligo d’autorizzazione

1 Chi intende effettuare sull’essere umano trapianti di organi, tessuti o cellule di origine animale oppure di espianti standardizzati fabbricati con essi necessita dell’autorizzazione dell’UFSP.

2 L’autorizzazione per una sperimentazione clinica è rilasciata se:

a.
si può escludere con grande probabilità un rischio di infezione per la popolazione;
b.
ci si può attendere un’utilità terapeutica;
c.
sono soddisfatti i requisiti tecnici e gestionali;
d.
vi è un adeguato sistema di garanzia della qualità.

3 L’autorizzazione per un trattamento standard è rilasciata se:

a.
si può escludere un rischio di infezione per la popolazione;
b.
l’utilità terapeutica è provata;
c.
sono soddisfatte le condizioni del capoverso 2 lettere c e d.
