Art. 20

1 The following rules govern the procedure for setting flight operations charges at the Geneva and Zurich Airports:

a.
The airport operator shall hold negotiations with airport users about the flight operations charges. If agreement is reached, the airport operator sets the charges based on this result (Section 3).
b.16
If no agreement is reached or if the result of the negotiations is rejected by the FOCA (Art. 26 para. 5), the airport operator may present the FOCA with a charge proposal for approval, calculating the charges on the basis of a comprehensive cost calculation in line with Section 4.

2 The airport operator may repeat steps in the procedure.

3 If the airport operator is obliged to adjust airport charges in accordance with this Ordinance or other binding agreements, it may not terminate the procedure. The airport operator may not repeat steps in the proceedings, with the exception of the comprehensive cost calculation in the event that the charge proposal is rejected by the FOCA.

Art. 20

1 Per determinare le tasse per le operazioni di volo agli aeroporti di Ginevra e Zurigo, si applicano le seguenti norme procedurali:

a.
l’esercente dell’aeroporto negozia le tasse per le operazioni di volo con gli utenti dell’aeroporto; se si giunge a un accordo, determina le tasse basandosi su tale risultato (sez. 3);
b.16
se non si giunge a un accordo o se il risultato del negoziato è respinto dall’UFAC (art. 26 cpv. 5), l’esercente dell’aeroporto può sottoporre a quest’ultimo per approvazione una proposta tariffale; calcola le tasse sulla base di un calcolo dei costi completo ai sensi della sezione 4.

2 L’esercente dell’aeroporto può ripetere passi della procedura.

3 Se, sulla base della presente ordinanza o di convenzioni in vigore, è tenuto ad adeguare le tasse aeroportuali, l’esercente dell’aeroporto non può interrompere la procedura. Non può ripetere passi della procedura, eccezion fatta per il calcolo dei costi completo in caso di rifiuto della proposta tariffale da parte dell’UFAC.
