Art. 22 Recusal

1 Persons assigned to work on the investigation shall recuse themselves if they:

a.
have a personal interest in the matter;
b.
are employed by an undertaking involved, are a member of its management bodies or are entrusted with its audit;
c.
are related in direct or collateral line or by marriage, engagement or adoption to:
1.
an owner, proprietor, or operator of a means of transport or of transport infrastructure that is involved in or affected by the incident,
2.
a manager or a member of a management body of an undertaking involved,
3.
a person involved in or affected by the incident,
4.
any other person with an interest in the outcome of the investigation;
d.
may not be impartial for any other reason.

2 If they have an interest in an undertaking that is involved, they must report this to the Director of the Investigation Bureau.

3 If there is any dispute over recusal, the STSB decides.

Art. 22 Ricusazione

1 Le persone di cui è prevista la partecipazione all’inchiesta devono ricusarsi se:

a.
hanno un interesse personale nella causa;
b.
sono impiegate presso un’impresa coinvolta, membri dei suoi organi direttivi o incaricate della revisione dei suoi conti;
c.
sono parenti o affini in linea retta o collaterale oppure legate per matrimonio, promessa nuziale o adozione con:
1.
il proprietario, il detentore, l’esercente di un mezzo o di un’infrastruttura di trasporto coinvolti in un evento imprevisto o da esso interessati,
2.
un dirigente o un membro degli organi direttivi di un’impresa coinvolta,
3.
una persona coinvolta nell’evento imprevisto o da esso interessata,
4.
un’altra persona interessata dall’esito della procedura;
d.
hanno per altri motivi una prevenzione nella causa.

2 Chi detiene una partecipazione all’impresa coinvolta, deve comunicarlo alla direzione dell’ufficio d’inchiesta.

3 Se la ricusazione è contestata, decide il SISI.
