Art. 44 Criteria for provisional taking out of service and backfitting of nuclear power plants

1 The holder of an operating licence must take the nuclear power plant out of service and backfit it if one or more of the following technical criteria are fulfilled:

a.
accident analyses indicate that core cooling in the event of an accident in accordance with Article 8 paragraphs 2 and 3 can no longer be assured and a dose of 100 mSv will be exceeded as a consequence;
b.
the integrity of the primary coolant system can no longer be assured;
c.
the integrity of the containment can no longer be assured.

2 In the analysis under paragraph 1 letter a, accidents with a frequency of more than 10-6 per year that are not triggered by natural events and natural events with a frequency of 10-4 per year must be taken into account.

3 The Department specifies the methodology and boundary conditions governing the review of criteria in an ordinance.

Art. 44 Criteri per la messa fuori servizio temporaneo e il riequipaggiamento di centrali nucleari

1 Il titolare di una licenza d’esercizio deve mettere senza indugio fuori servizio temporaneo la centrale nucleare e riequipaggiarla se è adempiuto uno o più dei seguenti criteri:

a.
le analisi degli incidenti mostrano che il raffreddamento del nocciolo, nel caso di un incidente di cui all’articolo 8 capoversi 2 e 3, non è più garantito e di conseguenza si supera una dose di 100 mSv;
b.
l’integrità del circuito primario non è più garantita;
c.
l’integrità del contenitore non è più garantita.

2 Nell’analisi di cui al capoverso 1 lettera a si devono considerare gli incidenti non cagionati da cause naturali con una frequenza annua superiore a 10‑6 e gli eventi naturali con una frequenza annua di 10‑4.

3 Il Dipartimento fissa in un’ordinanza la metodica e le condizioni marginali per la verifica dei criteri.
