Art. 3

1 The following may be used exclusively for Swiss watches and Swiss watch movements:

a.
the designation «Switzerland»;
b.
designations such as «Swiss», «Swiss product», «Made in Switzerland», «Swiss quality» and other designations containing «Switzerland» or «Swiss» or designations that could be confused with them;
c.
the Swiss cross and other signs that could be confused with it.24

1bis Swiss indications of source for specific activities in accordance with Article 47 paragraph 3ter TmPA25 are only permitted if the indication is not understood by the relevant public as an indication of source for the product as a whole.26

2 If the watch is not Swiss, the designations specified in paragraph 1 may still be placed on Swiss movements, provided that they are not visible to the buyer.

3 The indication «Swiss movement» may be placed on watches that contain a Swiss movement. The word «movement» must be written in full and must be of the same typeface, size and colour as the designation «Swiss».

4 Paragraphs 1 and 3 also apply when these designations are used either in translation or with the indication of the actual origin of the watch, or with the addition of words such as «kind», «type», «style» or other combinations of words.

5 In addition to the placing of these designations on the watch or its packaging, the following constitute use:

a.
the sale, the offering for sale or the placing on the market of watches bearing such a designation;
b.
the placing of these designations on shop signs, advertisements, prospectuses, invoices, business letters or business papers.

Art. 3

1 Per orologi e movimenti svizzeri possono essere utilizzati unicamente:

a.
la denominazione «Svizzera»;
b.
le indicazioni quali «svizzero», «prodotto svizzero», «fabbricato in Svizzera» o «qualità svizzera» e altre denominazioni contenenti il nome «Svizzera» o che possono essere confuse con quest’ultimo;
c.
la croce svizzera e i segni che possono essere confusi con essa.24

1bis Le indicazioni di provenienza svizzere concernenti attività specifiche secondo l’articolo 47 capoverso 3ter LPM25 sono ammesse solo se l’indicazione non è compresa dalle cerchie interessate determinanti come indicazione di provenienza relativa al prodotto nel suo insieme.26

2 Se l’orologio non è svizzero, le denominazioni che figurano nel capoverso 1 possono tuttavia essere apposte sui movimenti svizzeri a condizione che esse non siano visibili all’acquirente dell’orologio.

3 La menzione «movimento svizzero» può essere apposta sugli orologi che contengono un movimento svizzero. Il termine «movimento» deve presentare per tutte le lettere, lo stesso tipo, dimensione e colore di quelle della denominazione «Svizzera».

4 I capoversi 1 e 3 sono pure applicabili qualora tali designazioni venissero usate tradotte (in particolare «Swiss», «Swiss made», «Swiss Movement») oppure con un accenno all’effettiva provenienza dell’orologio, con l’aggiunta di parole quali «genere», «tipo», «façon» o in combinazione con altre parole.

5 Per uso s’intende, oltre all’apposizione di tale indicazione sugli orologi o sui loro imballaggi anche:

a.
la vendita, l’offerta di vendita o la messa in circolazione di orologi con una siffatta indicazione;
b.
l’apposizione di tale designazione su insegne, annunci, prospetti, fatture, lettere o carte di commercio.
