Art. 52 Refusal of protection and invalidation

1 The following applies for internationally registered trade marks:

a.
the refusal of protection shall replace the refusal of an application for registration under Article 30 paragraph 2 letters a and c–e TmPA and the revocation of the registration under Article 33 TmPA;
b.
the invalidation shall replace the cancellation of the registration under Article 35 letters c–e TmPA.

2 The IPI shall not publish the refusal of protection nor the invalidation.

Art. 52 Rifiuto di protezione e invalidazione

1 Le seguenti regole si applicano ai marchi iscritti nel registro internazionale:

a.
il rifiuto di protezione sostituisce il rigetto della domanda di registrazione giusta l’articolo 30 capoverso 2 lettere a e c–e LPM e la revoca della registrazione giusta l’articolo 33 LPM;
b.
l’invalidazione sostituisce la cancellazione della registrazione giusta l’articolo 35 lettere c–e LPM.

2 L’IPI non pubblica il rifiuto di protezione né l’invalidazione.
