Art. 36 Content

1 The IPI shall maintain a dossier for each application for registration and each trade mark registration, containing the following:

a.
the stages of the registration procedure, any opposition proceedings and any cancellation procedures on the grounds of non-use;
b.
the renewal and cancellation of the registration, any international registration as well as any amendments to trade mark law;
c.
other amendments to the trade mark registration.69

2 The regulations for a guarantee or collective mark or the regulations for a geographical mark must also be included in the dossier.70

3 Official documents of evidence that disclose manufacturing or trade secrets shall be filed separately on request. This will be noted in the dossier.71

Art. 36 Contenuto

1 Per ogni domanda di registrazione e per ogni registrazione di marchi l’IPI tiene un fascicolo nel quale sono raccolti:

a.
lo svolgimento della procedura di registrazione, di un’eventuale procedura d’opposizione e di un’eventuale procedura di cancellazione per mancato uso;
b.
la proroga e la cancellazione della registrazione, un’eventuale registrazione internazionale, le modificazioni del diritto al marchio;
c.
qualsiasi altra modificazione della registrazione.69

2 Il regolamento di un marchio di garanzia, di un marchio collettivo o di un marchio geografico fa parimenti parte del fascicolo.70

3 Su domanda, i documenti di prova che contengono segreti di fabbricazione o d’affari sono conservati separatamente. Questo fatto è menzionato nel fascicolo.71
