1 The proprietor may assign his trade mark in whole or in part for the goods or services for which it has been claimed.
2 The assignment is only valid if evidenced in writing. It is only effective in relation to third parties who are acting in good faith once it has been entered in the Register.
3 Actions under this Act may be brought against the previous proprietor up to the entry of the assignment in the Register.
4 Unless otherwise agreed, the assignment of an undertaking also includes the assignment of its trade marks.
1 Il titolare del marchio può trasferire, interamente o in parte, il diritto al marchio per i prodotti o i servizi per i quali esso è rivendicato.
2 Il trasferimento è valido soltanto nella forma scritta. Esso è opponibile ai terzi di buona fede soltanto dopo la registrazione.
3 Le azioni previste dalla presente legge possono essere intentate contro il precedente titolare fino alla registrazione del trasferimento.
4 Salvo convenzione contraria, il trasferimento dell’azienda implica il trasferimento del relativo diritto al marchio.
