Art. 41 Procedure for urgent social assistance

(Art. 33 para. 2 SAA)

1 Contributions to living expenses that are paid as urgent social assistance are deducted from any recurring benefits that are subsequently approved.

2 If urgent social assistance is required during a temporary stay in Switzerland, it is granted by the canton of stay in accordance with cantonal law.

3 The Confederation reimburses these costs to the canton of stay, provided the following conditions are met:

a.
the person receiving assistance is a Swiss national living abroad in accordance with Article 3 letter a SAA;
b.
the need has been proven;
c.
the canton of stay has attempted to obtain reimbursement from the person receiving support or a third party, but these efforts have been unsuccessful.

4 The administrative costs of the canton of stay are not reimbursed.

5 The repayment obligation lapses three years after the costs are incurred.

Art. 41 Procedura in caso di aiuto sociale urgente

(art. 33 cpv. 2 LSEst)

1 I contributi volti a compensare il costo della vita concessi come aiuto sociale urgente sono computati nelle prestazioni periodiche autorizzate che verranno eventualmente autorizzate in un secondo momento.

2 L’aiuto sociale urgente che si rende necessario durante un soggiorno temporaneo in Svizzera è concesso dal Cantone di dimora conformemente al diritto cantonale.

3 La Confederazione rimborsa le spese sostenute al Cantone di dimora se sono soddisfatte le seguenti condizioni:

a.
il richiedente è uno Svizzero all’estero secondo l’articolo 3 lettera a LSEst;
b.
la situazione di emergenza è comprovata;
c.
il Cantone di dimora ha chiesto la restituzione al richiedente o a terzi ma senza successo.

4 Le spese amministrative del Cantone di dimora non sono rimborsate.

5 L’obbligo di rimborso si estingue dopo tre anni dall’insorgere delle spese.
