Art. 23 Electronic auctions

¹ The contracting authority may hold an electronic auction for the procurement of standardised goods, work or services within the framework of a procedure under this Act. In this case, the tenders are revised after an initial full evaluation and re-ranked using electronic aids and, if necessary, multiple rounds. Reference must be made to this in the invitation to tender.

² The electronic auction covers the following areas:

a.: prices where the contract is to be awarded to the tenderer with the lowest total price; or
b.: prices and values for quantifiable components such as weight, purity or quality where the contract is to be awarded to the most advantageous tender.

³ The contracting authority checks whether the tenderers meet the eligibility criteria and whether the tenders fulfil the technical specifications. It carries out an initial evaluation of the tenders based on the award criteria and the weighting established for this purpose. Before the auction begins, it provides each tenderer with the following:

a.: the automatic evaluation method, including the mathematical formula based on the award criteria specified;
b.: the result of the initial evaluation of its tender; and
c.: all other relevant information regarding the auction process.

⁴ All eligible tenderers are simultaneously invited electronically to submit new or amended tenders. The contracting authority may limit the number of eligible tenderers, provided it announced this in the invitation to tender or in the tender documentation.

⁵ The electronic auction may comprise several successive rounds. The contracting authority informs all tenderers of their rank in each round.

Art. 23 Aste elettroniche

¹ Per l’acquisto di prestazioni standardizzate in una procedura secondo la presente legge il committente può svolgere un’asta elettronica. Nell’ambito di un’asta elettronica, dopo una prima valutazione completa le offerte sono rielaborate e, mediante mezzi elettronici ed eventualmente attraverso più turni ripetuti, riclassificate. L’intenzione di ricorrere a un’asta elettronica deve essere menzionata nel bando.

² L’asta elettronica concerne:

a.: i prezzi, in caso di aggiudicazione al prezzo complessivo più basso; o
b.: i prezzi e i valori di elementi quantificabili, come il peso, la purezza o la qualità, in caso di aggiudicazione all’offerta più vantaggiosa.

³ Il committente verifica se gli offerenti soddisfano i criteri di idoneità e se le offerte adempiono le specifiche tecniche. Effettua una prima valutazione delle offerte sulla base dei criteri di aggiudicazione e della relativa ponderazione. Prima dell’inizio dell’asta il committente mette a disposizione di ogni offerente:

a.: il metodo di valutazione automatica, compresa la formula matematica fondata sui criteri di aggiudicazione menzionati;
b.: il risultato della prima valutazione della sua offerta; e
c.: tutte le altre informazioni rilevanti per lo svolgimento dell’asta.

⁴ Tutti gli offerenti ammessi a partecipare sono invitati simultaneamente e per via elettronica a presentare offerte nuove oppure adattate. Il committente può limitare il numero degli offerenti ammessi, sempre che lo abbia indicato nel bando o nella relativa documentazione.

⁵ L’asta elettronica può comprendere più turni successivi. In ogni turno il committente informa tutti gli offerenti in merito alla loro posizione nella classifica.
