1 The competent authorities may also notify persons applying for asylum at the border or at the border control at a Swiss airport (Art. 21–23) of a ruling by providing them with a signed copy of the ruling that has been transmitted by fax. The persons concerned must confirm in writing that they have received the ruling; in the absence of such confirmation, the competent authority shall formally record that the ruling has been received. Article 11 paragraph 3 of the APA31 does not apply. Any agent shall be informed of the notification.

3 In other urgent cases, SEM may authorise a cantonal authority, a Swiss diplomatic mission or a consular representation abroad (Swiss representation) to notify those concerned of a ruling by providing them with a signed copy of the ruling that has been transmitted by fax.

1 Le autorità competenti possono notificare alla persona che presenta la domanda d’asilo alla frontiera o a un posto di controllo di un aeroporto svizzero (art. 21–23) anche decisioni firmate, trasmesse per telefax. La persona interessata deve confermarne il ricevimento per scritto; altrimenti l’autorità competente registra come avvenuta la consegna. Non è applicabile l’articolo 11 capoverso 3 PA32. La notificazione è comunicata al procuratore.

3 In altri casi urgenti, la SEM può autorizzare un’autorità cantonale, una missione diplomatica svizzera o un posto consolare all’estero (rappresentanza svizzera) a notificare decisioni firmate trasmesse per telefax.
