Art. 48 Subsequent monitoring (supervising the market) in accordance with this Ordinance

1 The cantons are responsible for subsequent monitoring (supervising the market) of organisms placed on the market which are not subject to the controls stipulated by Article 47.

2 The cantonal authorities shall monitor by spot checks or at the request of the FOEN, in particular, whether:

a.
the regulations regarding the informing of recipients (Art. 5) are being observed;
b.
the marketing of genetically modified or pathogenic organisms has been authorised;
c.
the handling of particular organisms is not prohibited;
d.
the conditions and stipulations linked to the issue of the marketing licence are being observed;
e.
genetically modified organisms are correctly labelled (Art. 10);
f.
the measures prescribed by the FOEN in accordance with paragraph 4 are being implemented.

3 If the monitoring shows that the provisions of paragraph 2 letters b-f are being contravened, the canton in which the distributor is resident or has business premises shall prescribe the necessary measures and inform the FOEN and the other cantons.

4 If the monitoring shows that provisions of this Ordinance concerning marketing are being contravened, the canton shall inform the FOEN. The FOEN shall conduct the necessary investigations, and prescribe the necessary measures. If the organisms in question may be placed on the market without a licence, Article 46 applies.

5 The samples, detection methods and materials required for monitoring shall be made available to the competent authorities.

6 If the monitoring shows that requirements in this Ordinance are being contravened, the persons responsible shall pay the costs of the monitoring. The monitoring authorities shall issue an invoice directly to these persons.

Art. 48 Contrôle ultérieur (surveillance du marché) en vertu de la présente ordonnance

1 Le contrôle ultérieur (surveillance du marché) des organismes mis en circulation qui ne sont pas contrôlés au sens de l’art. 47 incombe aux cantons.

2 Ils contrôlent, par sondages ou sur demande de l’OFEV, notamment si:

a.
les prescriptions relatives à l’information de l’acquéreur (art. 5) sont respectées;
b.
la mise en circulation d’organismes génétiquement modifiés ou pathogènes est autorisée;
c.
l’utilisation de certains organismes n’est pas interdite;
d.
les conditions et les charges fixées dans l’autorisation de mise en circulation sont respectées;
e.
les organismes génétiquement modifiés sont désignés correctement (art. 10);
f.
les mesures ordonnées par l’OFEV au sens de l’al. 4 sont observées.

3 Si le contrôle indique que des dispositions de l’al. 2, let. b à f, sont violées, le canton dans lequel le responsable de la mise en circulation a son domicile ou son siège social ordonne les mesures requises et informe l’OFEV et les autres cantons;

4 Si le contrôle indique que les dispositions de la présente ordonnance concernant la mise en circulation sont violées, le canton informe l’OFEV. L’office effectue les enquêtes nécessaires et ordonne les mesures requises. S’il s’agit d’organismes pouvant être mis en circulation sans autorisation au sens de la présente ordonnance, l’art. 46 s’applique.

5 Les échantillons ainsi que les moyens et les méthodes de détection nécessaires aux contrôles doivent être mis à la disposition des autorités compétentes.

6 Si le contrôle indique que des dispositions de la présente ordonnance sont violées, le responsable doit supporter les frais du contrôle. L’autorité chargée du contrôle lui envoie directement la facture.
