Art. 43 Unjustified radiation exposure of persons

1 Any person who wilfully subjects someone to manifestly unjustified radiation exposure shall be liable to a custodial sentence not exceeding three years or to a monetary penalty.34

2 Any person who wilfully subjects another to manifestly unjustified radiation exposure with the intention of damaging that person’s health shall be liable to a custodial sentence or to a monetary penalty.35

3 Any person who negligently subjects another to manifestly unjustified radiation exposure shall be liable to a custodial sentence not exceeding three years or to a monetary penalty.36

Art. 43 Exposition injustifiée de tiers à l’irradiation

1 Est puni d’une peine privative de liberté de trois ans au plus ou d’une peine pécuniaire quiconque, intentionnellement, expose un tiers à des irradiations manifestement injustifiées.

2 Est puni d’une peine privative de liberté ou d’une peine pécuniaire quiconque, intentionnellement, expose un tiers à des irradiations manifestement injustifiées, dans le but de nuire à sa santé.

3 Est puni d’une peine privative de liberté de trois ans au plus ou d’une peine pécuniaire quiconque, par négligence, expose un tiers à des irradiations manifestement injustifiées.
