Art. 32 Duty to provide information

1 When procuring biometric data and personal data on the applicant, the applicant shall be notified in writing of the following:

a.
the identity of the proprietor of the data collection;
b.
the purpose of processing the data in ORBIS and in the C-VIS;
c.
the categories of the data recipient;
d.
the duration of the storage of data in ORBIS and in the C-VIS;
e.
that the recording of the data is required to verify the application;
f.
that he or she has a right to information, correction and deletion, the procedure for asserting these rights and how to contact the Federal Data Protection and Information Commissioner (FDPIC).

2 The natural person or legal entity that has invited the applicant or must bear the costs of subsistence during his or her stay shall also receive the information under paragraph 1.

Art. 32 Obligation d’informer

1 Lors de la collecte des données biométriques et personnelles du demandeur, celui-ci est informé par écrit:

a.
de l’identité du maître du fichier;
b.
des finalités du traitement des données dans ORBIS et dans le C-VIS;
c.
des catégories de destinataires des données;
d.
de la durée de conservation des données dans ORBIS et dans le C-VIS;
e.
du caractère obligatoire de la saisie des données pour l’examen de la demande;
f.
de l’existence du droit d’accès, du droit à la rectification et du droit à l’effacement des données, des procédures à suivre pour exercer ces droits et des coordonnées du préposé fédéral à la protection des données et à la transparence (PFPDT).

2 La personne physique ou morale qui adresse une invitation au demandeur de visa ou qui est susceptible de prendre en charge ses frais de subsistance durant son séjour reçoit également les informations visées à l’al. 1.
