Art. 9 Schrittweise Umstellung

1 Ist eine sofortige vollständige Umstellung mit unzumutbar hohen Risiken verbunden, so kann ein Biobetrieb mit Wein‑, Obst‑, Gemüse- oder Zierpflanzenanbau schrittweise auf die biologische Produktion umstellen. Der gesamte Betrieb muss innert fünf Jahren vollständig umgestellt werden; vorbehalten bleiben Betriebe nach Artikel 7 Absatz 1.

2 Die Zertifizierungsstelle entscheidet über die Zulassung der schrittweisen Umstellung.47

3 Voraussetzung dazu ist insbesondere:

a.
die Erstellung eines verbindlichen Umstellungsplanes mit einer detaillierten Beschreibung der Umstellungsschritte und einem Zeitplan;
b.
die Verhinderung jeglicher Abdrift von unerlaubten Hilfsstoffen;
c.
die eindeutige Abgrenzung der unterschiedlich bewirtschafteten Flächen;
d.
die getrennte Ernte und Lagerung der unterschiedlich produzierten Erzeugnisse;
e.48
die Erbringung des ökologischen Leistungsnachweises nach den Artikeln 11–25 DZV49 für die nicht biologisch bewirtschafteten Flächen;
f.
die jährliche Entnahme einer Stichprobe zur Rückstandsanalyse von den biologisch produzierten Produkten;
g.50
Die Einhaltung der weiteren Anforderungen im Anhang 1.

4 Ist die sofortige vollständige Umstellung der Nutztierhaltung nicht zumutbar, so kann die Zertifizierungsstelle dem Betrieb gestatten, die Tierhaltung innert drei Jahren schrittweise nach Tierkategorien umzustellen.51

5 Nicht zulässig ist die Parallelproduktion von:

a.
nicht eindeutig unterscheidbaren Sorten;
b.
Tieren der gleichen Nutztierkategorie.52

Art. 9 Conversion in stages

1 If immediate total conversion involves unacceptably high risks, an organic holding growing vines, fruit, vegetables or ornamental plants may convert to organic production in stages. The entire holding must be fully converted within five years, with the exception of holdings referred to in Article 7 paragraph 1.

2 The certification body shall decide whether to authorise conversion in stages.47

3 In particular, the following conditions must be met:

a.
a binding conversion plan is drawn up with a detailed description of the conversion stages and a timetable;
b.
any contamination of organic parcels with unauthorised agrochemicals is avoided;
c.
areas farmed in different ways are clearly marked out;
d.
products produced under different methods are harvested and stored separately;
e.48
proof of ecological performance in accordance with Articles 11–25 of the DPO49 is provided for areas not farmed organically;
f.
a sample is taken each year for analysis of the residues in organically produced products;
g.50
the requirements laid down in the Annex are met.

4 If immediate total conversion of livestock production is not reasonable, the certification body may allow the holding to convert livestock farming in stages according to animal categories within three years.51

5 Parallel production of the following is not permitted:

a.
varieties which are not clearly distinguishable;
b.
animals of the same category of production animal.52
