Art. 27 Zuteilungsverfahren

1 Die Bearbeitung eines Registrierungsgesuchs durch die Registerbetreiberin wird mit der Zuteilung oder der Verweigerung der Zuteilung des beantragten Domain-Namens abgeschlossen.

2 Die Registerbetreiberin teilt das Nutzungsrecht an einem Domain-Namen zu. Die Zuteilung tritt mit der elektronischen Bestätigung in Kraft, die über das Registrierungssystem an den Registrar erfolgt, der im Auftrag der Gesuchstellerin oder des Gesuchstellers tätig ist.

3 Sie teilt die Verweigerung der Zuteilung eines Domain-Namens dem Registrar, der im Auftrag der Gesuchstellerin oder des Gesuchstellers tätig ist, elektronisch über das Registrierungssystem oder nötigenfalls auf anderem Wege mit. Sie teilt der Gesuchstellerin oder dem Gesuchsteller die Verweigerung der Zuteilung eines Domain-Namens, der mittels Namenszuteilungsmandat nach Artikel 56 zugeteilt werden muss, direkt mit einem geeigneten Kommunikationsmittel mit.34

4 Das BAKOM entscheidet über die Verweigerung der Zuteilung eines Domain-Namens, wenn innerhalb von 40 Tagen ab Mitteilung der Verweigerung nach Absatz 3 die Gesuchstellerin oder der Gesuchsteller:35

a.
einen solchen Entscheid verlangt; und
b.
eine gültige Korrespondenzadresse in der Schweiz angibt, falls ihr oder sein Sitz oder Wohnsitz sich im Ausland befindet.

Art. 27 Allocation process

1 The processing of a registration application by the registry concludes with the allocation or the refusal of allocation of the requested domain name.

2 The registry allocates the right to use a domain name. The allocation takes effect on its confirmation in electronic form via the registry system to the registrar operating on behalf of the applicant concerned.

3 The registry shall notify the registrar acting on behalf of the applicant concerned of the refusal to allocate a domain name via the registration system in electronic form or if necessary by other means. It shall directly notify the applicant of the refusal to allocate a domain name that must be allocated by means of a naming mandate under Article 56 using an appropriate means of communication.34

4 OFCOM shall make a decision on the refusal to allocate a domain name if, within 40 days of receiving notification of a refusal under paragraph 3, the applicant:35

a.
requests such a decision; and
b.
provides a valid correspondence address in Switzerland if they are registered or domiciled abroad.
