Art. 8a Anmerkung im Grundbuch

1 Die Nutzungsbeschränkung als biologischer oder geologischer Speicher von Kohlenstoff ist auf Anmeldung des BAFU im Grundbuch anzumerken. Dies gilt nicht für die Speicherung von Kohlenstoff in Baustoffen.

2 Das BAFU meldet die Löschung der Anmerkung im Grundbuch an, wenn:

a.
das Projekt oder Programm beendet ist, frühestens jedoch 30 Jahre nach Wirkungsbeginn; oder
b.
der gespeicherte Kohlenstoff vor diesem Zeitpunkt auf dem betroffenen Grundstück freigesetzt wird.

3 Die Eigentümerin oder der Eigentümer des betroffenen Grundstücks trägt die Kosten für den Eintrag, die Änderung und die Löschung der Anmerkung.

4 Die Kantone informieren das BAFU unverzüglich, sobald das betroffene Grundstück anderweitig genutzt wird.

Art. 8a Note in the land register

1 The restriction on use as a biological or geological carbon store must be noted in the land register at the FOEN’s request. The foregoing does not apply to storing carbon in construction materials.

2 The FOEN shall request the deletion of the note in the land register if:

a.
the project or programme has ended, but at the earliest 30 years after it starts to take effect; or
b.
the stored carbon is released on the property concerned before that time.

3 The owner of the property concerned shall bear the costs of the entry, amendment and deletion of the note.

4 The cantons shall notify the FOEN immediately if the property concerned is used for a different purpose.
