Art. 10 Aufgaben des BAFU

1 Das BAFU ist die zuständige Behörde und Kontaktstelle für das Nagoya-Protokoll. Es hat insbesondere folgende Aufgaben:

a.
Es führt eine nationale Informationsstelle (nationales Access and Benefit-sharing Clearing-House).
b.
Es gewährleistet die Verbindung mit dem Sekretariat nach Artikel 24 des Übereinkommens vom 5. Juni 19926 über die Biologische Vielfalt und der internationalen Informationsstelle (internationales Access and Benefit-sharing Clearing-House).
c.
Es erfüllt die Aufgaben nach Artikel 13 des Nagoya-Protokolls.
d.
Es gewährleistet den Informationsaustausch mit dem internationalen Access and Benefit-sharing Clearing-House nach Artikel 14 des Nagoya-Protokolls.
e.
Es stellt auf Anfrage anderen Vertragsparteien des Nagoya-Protokolls Informationen im Zusammenhang mit der Einhaltung der Sorgfaltspflicht zur Verfügung; vertrauliche Informationen werden nur zur Verfügung gestellt, wenn ein dem schweizerischen Recht entsprechendes Amtsgeheimnis und ein angemessener Persönlichkeitsschutz gewährleistet sind.
f.
Es betreibt eine elektronische Datenbank, in welcher die Informationen im Zusammenhang mit den Pflichten nach den Artikeln 3–5 und 8 erfasst werden.
g.
Es veröffentlicht die Informationen nach Artikel 23o Absatz 2 zweiter Satz NHG und weitere nicht vertraulichen Informationen im Zusammenhang mit den Pflichten nach Artikel 3–5 und 8.
h.
Es führt eine formelle Überprüfung der Meldungen nach den Artikeln 4 und 8 durch.
i.
Es prüft die Einhaltung der Pflichten nach den Artikeln 3–5 und 8, wenn konkrete Hinweise auf deren Verletzung vorliegen oder wenn es stichprobenweise Kontrollen durchführt; es kann dazu die Kantone beiziehen.
j.
Es führt ein öffentliches Verzeichnis mit den bewährten Verfahren, den anerkannten Sammlungen und den anderen Verfahren nach Artikel 8 Absatz 7.
k.
Es sorgt dafür, dass bei Bedarf Veranstaltungen im Zusammenhang mit der Ausführung des Nagoya-Protokolls durchgeführt werden.
l.
Es erstattet Bericht nach Artikel 29 des Nagoya-Protokolls.

2 Das BAFU ermutigt die Nutzenden, Vorteile, die sich aus der Nutzung von genetischen Ressourcen oder auf sich darauf beziehendem traditionellem Wissen ergeben, auch bei Fehlen einer Rechtspflicht freiwillig in ausgewogener und gerechter Weise zu teilen. Es setzt sich dafür ein, dass die Vorteile für die Erhaltung der biologischen Vielfalt und die nachhaltige Nutzung ihrer Bestandteile eingesetzt werden.

Art. 10 Duties of the FOEN

1 The FOEN is the competent authority and focal point for the Nagoya Protocol. It has the following specific tasks:

a.
It operates a national Access and Benefit-sharing Clearing-House.
b.
It ensures the liaison between the Secretariat under Article 24 of the Convention of 5 June 19926 on Biological Diversity and the international Access and Benefit-sharing Clearing-House.
c.
It carries out the tasks specified in Article 13 of the Nagoya Protocol.
d.
It ensures the exchange of information with the international Access and Benefit-sharing Clearing-House under Article 14 of the Nagoya Protocol.
e.
At the request of other Parties to the Nagoya Protocol, it makes available information relating to compliance with the due diligence requirement; confidential information is made available only if the official secrecy and appropriate protection of privacy are ensured in accordance with Swiss law.
f.
It operates an electronic database that contains information relating to the requirements under Articles 3–5 and 8.
g.
It publishes information as specified in Article 23o paragraph 2 second sentence NCHA and other non-confidential information relating to the requirements under Articles 3–5 and 8.
h.
It performs a formal verification of the notifications under Articles 4 and 8.
i.
It verifies compliance with the requirements under Articles 3–5 and 8 if tangible signs of their violation exist or when carrying out spot checks; it may also involve the cantons.
j.
It operates a public register of best practices, recognised collections and other procedures as specified in Article 8 paragraph 7.
k.
It ensures that events related to the execution of the Nagoya Protocol are held, as necessary.
l.
It issues reports as specified in Article 29 of the Nagoya Protocol.

2 The FOEN encourages users to voluntarily share the benefits arising from the utilisation of genetic resources or associated traditional knowledge in a fair and equitable way even when there is no legal obligation to do so. It aims to ensure that the benefits are used to conserve biological diversity and the sustainable use of their components.
