142.20 Federal Act of 16 December 2005 on Foreign Nationals (FNA)

Art. 73 Fermanza curta

1 L’autoritad federala u chantunala cumpetenta po tegnair en fermanza persunas che n’han nagina permissiun da dimora curta, nagina permissiun da dimora u nagina permissiun da domicil:

a.
per avrir ina disposiziun en connex cun lur status da dimora;
b.
per constatar lur identitad u lur naziunalitad, uschenavant che lur cooperaziun persunala è necessaria per far quai.

2 La persuna dastga vegnir tegnida en fermanza mo per la durada da la cooperaziun u da l’interrogaziun necessaria sco er per il transport ch’è eventualmain necessari, maximalmain dentant 3 dis.

3 Sch’ina persuna vegn tegnida en fermanza, sto ella:

a.
vegnir infurmada davart il motiv da sia fermanza;
b.
avair la pussaivladad d’entrar en contact cun las persunas che la surveglian, sch’ella basegna agid.

4 Sche la fermanza dura probablamain dapli che 24 uras, sto la persuna pertutgada survegnir avant la pussaivladad da liquidar u da laschar liquidar chaussas persunalas urgentas.

5 Sin dumonda sto l’autoritad giudiziala cumpetenta controllar posteriuramain la legitimitad da la fermanza.

6 La durada da la fermanza na vegn betg messa a quint a la durada d’in eventual arrest d’expulsiun, d’in eventual arrest preparatoric u d’in eventual arrest pervia d’insubordinaziun.

Art. 73 Temporary detention

1 The competent authority of the Confederation or the canton may detain persons who do not hold a short stay, residence or settlement permit:

a.
to notify them of a decision in connection with their residence status;
b.
to determine their identity or nationality, as far as their personal cooperation is required.

2 The person may be detained only for the duration of the required cooperation or questioning and the required transport if necessary, and for a maximum of three days.

3 If a person is detained, they must:

a.
be informed of the reason for their detention;
b.
be permitted to contact the persons guarding them if they require help.

4 If detention is expected last longer than 24 hours, the person concerned shall be given the opportunity beforehand to attend to or have someone else attend to urgent personal matters.

5 On request, the competent judicial authority must review the legality of the detention.

6 The duration of detention shall not be deducted from the duration of any detention pending deportation, in preparation for departure, or coercive detention.
