Art. 7 Estensione dell’Accordo e applicazione

7.1  Le disposizioni del presente Accordo si applicano

a)
ai progetti e programmi convenuti tra i Governi;
b)
ai progetti e programmi convenuti tra il Governo svizzero e altre autorità a livello di repubbliche o municipalità o qualsiasi altra istanza ufficialmente riconosciuta dal Governo iugoslavo;
c)
ai progetti e programmi concordati con società o enti di diritto pubblico di ciascun Paese per i quali i due Governi o i loro rappresentanti autorizzati hanno convenuto di applicare, mutatis mutandis, le disposizioni dell’articolo 5.

7.2  Il presente Accordo si applica retroattivamente ai progetti e programmi in elaborazione o in corso di realizzazione prima della sua entrata in vigore.

7.3  Qualora dovessero sorgere divergenze riguardo alle disposizioni del presente Accordo e degli accordi precedenti enumerati qui appresso4, prevarranno questi ultimi.

Agreement on the equipment of the Federal, the Serbian and the Montenegrin ministries of interior affairs with internal communication technology, signed in Belgrade on October 29, 2001
–
Agreement on the support for the enhancement of the Institute of Comparative Law, signed in Belgrade on November 10, 2001
–
Agreement on trade and economic co-operation between the Swiss Confederation and the Federal Republic of Yugoslavia, signed in Belgrade on November 21, 20015
–
Memorandum of Understanding concerning the granting of financial assistance for the delivery of spare parts in the electricity sector of Yugoslavia, Serbia and Montenegro, signed in Belgrade on December 5, 2001
–
Letter of Intent on the establishment of the Education Reform Coordination Unit, signed in Belgrade on December 5, 2001
–
Statement of Intent concerning cooperation in structure reforms of the Yugoslav Ministry of Foreign Affairs, signed in Berne on January 21, 2002.

7.4  Dalla sua entrata in vigore il presente Accordo sostituisce

–
l’Accordo tra il Consiglio federale svizzero e il Consiglio esecutivo federale dell’Assemblea della Repubblica socialista federativa di Jugoslavia relativo alla reciproca prestazione di aiuto in caso di catastrofe naturale, firmato a Belgrado il 9 novembre 19826;
–
l’Accordo di cooperazione tecnica tra la Confederazione Svizzera e la Repubblica socialista federativa di Jugoslavia, firmato il 1° dicembre 19667

per quanto concerne il territorio della Repubblica federale di Iugoslavia.

Art. 7 Etendue de l’Accord et application

7.1  Les dispositions du présent Accord s’appliquent

a)
aux projets/programmes convenus entre les Gouvernements;
b)
aux projets/programmes convenus entre le Gouvernement suisse et d’autres autorités à l’échelon des républiques ou des municipalités, ou toute autre instance officiellement reconnue par le Gouvernement yougoslave;
c)
aux projets/programmes convenus avec des sociétés ou des institutions de droit public ou privé de l’un ou l’autre des deux pays, pour lesquels les deux Gouvernements ou leurs représentants agréés ont convenu d’appliquer, mutatis mutandis, les dispositions de l’art. 5.

7.2  Le présent Accord s’applique rétroactivement aux projets/programmes en préparation ou en cours avant son entrée en vigueur.

7.3  En cas de divergences entre les dispositions du présent Accord et celles des accords précédents énumérés ci-dessous4, ce sont ces derniers qui prévaudront.

7.4  A son entrée en vigueur, le présent Accord remplace

–
l’Accord entre le Conseil fédéral suisse et le Conseil exécutif fédéral de l’Assemblée de la République socialiste fédérative de Yougoslavie portant sur la prestation mutuelle d’aide en cas de catastrophe naturelle6, signé à Belgrade le 9 novembre 1982;
–
l’Accord de coopération technique entre la Confédération suisse et la République socialiste fédérative de Yougoslavie7, signé le 1er décembre 1966

pour ce qui concerne le territoire de la République fédérale de Yougoslavie.
