Art. 34 Prodotti contestati

¹ Se hanno contestato un prodotto, le autorità di esecuzione ordinano le misure necessarie per ripristinare la situazione legale.

² Possono decidere che il prodotto contestato:

a.: può essere utilizzato, con o senza oneri;
b.: deve essere eliminato dall’azienda, a sue spese;
c.: deve essere confiscato, reso inoffensivo, utilizzato in modo inoffensivo o eliminato, a spese dell’azienda.

³ Possono obbligare la persona responsabile in seno all’azienda a:

a.: chiarire le cause dei difetti;
b.: adottare misure adeguate;
c.: informare le autorità di esecuzione sulle misure adottate.

⁴ Se gli oneri sono ripetutamente disattesi, le autorità di esecuzione possono ordinare l’eliminazione o la confisca del prodotto.

⁵ Se un prodotto è contestato, al momento dell’importazione le autorità di esecuzione possono anche:

a.: respingerlo;
b.: consegnarlo, per complemento di inchiesta, alla competente autorità cantonale di esecuzione;
c.: rispedirlo, con il consenso della persona responsabile della spedizione e dell’autorità competente del Paese di origine;
d.: spedirlo, su domanda della persona responsabile della spedizione, in un nuovo Paese di destinazione, con il consenso dell’autorità competente di tale Paese.

Art. 34 Products in respect of which a complaint has been filed

¹ If the enforcement authorities have filed a complaint about a product, they shall order the measures required to restore it to its lawful state.

² They may order that the product complained of:

a.: may be used and whether such use is subject to conditions;
b.: must be disposed of by the company at its expense;
c.: must be confiscated, rendered harmless, recycled in a harmless manner or disposed of at the expense of the company.

³ They may require the responsible person at the business:

a.: to investigate the deficiencies;
b.: to take suitable measures;
c.: to inform the enforcement authorities of the measures taken.

⁴ If requirements are repeatedly disregarded, the enforcement authorities may order the disposal or the forfeiture of the product.

⁵ In relation to imports, the enforcement authorities may also order that a product complained of:

a.: be refused entry;
b.: be given to the competent cantonal enforcement authority for further testing;
c.: be sent back, provided the person responsible for shipping and the competent authority of the country of origin agree;
d.: be sent to a new country of destination at the request of the person responsible for shipping provided the competent authority of the country of destination agrees.
