Art. 36 Ubicazione di discariche e relative opere di costruzione

1 All’ubicazione di discariche e alle relative opere di costruzione si applicano i requisiti di cui all’allegato 2.

2 Le discariche di tipo E non possono essere sotterranee. Altre discariche possono essere sotterranee, previa approvazione dell’UFAM, se:

a.
i rifiuti sono depositati in cavità stabili fino alla fine della fase di manutenzione postoperativa;
b.
si fornisce la prova che le discariche, con eccezione di quelle di tipo A, non possono essere nocive per l’ambiente fino al termine della fase di manutenzione postoperativa;
c.
trattandosi di discariche di tipo D, vi sono depositate esclusivamente scorie provenienti da impianti nei quali vengono inceneriti rifiuti urbani o rifiuti di composizione analoga e viene impedita la formazione di gas mediante misure idonee.

3 Se secondo le prescrizioni della legislazione sulla protezione delle acque è ammesso modificare il tracciato di un corso d’acqua per realizzare una discarica:

a.
il corso d’acqua dev’essere fatto defluire intorno alla discarica;
b.
dev’essere garantito che non vi siano infiltrazioni all’interno della discarica.

Art. 36 Location and structure of landfills

1 The requirements specified in Annex 2 apply to the location and the structure of landfills.

2 Type E landfills may not be constructed underground. Other landfills may be constructed underground with the FOEN’s consent provided:

a.
the waste is deposited in a stable cavity until the end of the after-care phase;
b.
it is demonstrated that the landfills, with the exception of Type A landfills, cannot harm the environment until the end of the after-care phase;
c.
in the case of Type D landfills, only slag is deposited that originates from facilities in which municipal waste or waste of similar composition is incinerated and appropriate measures are taken to prevent the build-up of gases.

3 In cases where it is permitted under the waters protection legislation to divert a body of flowing water for the construction of a landfill:

a.
the bodies of water must be diverted around the landfill;
b.
it must be ensured that no water can intrude into the landfill.
