814.01 Federal Act of 7 October 1983 on the Protection of the Environment (Environmental Protection Act, EPA)
Art. 61 Contravvenzioni
1 È punito con la multa sino a 20 000 franchi chiunque intenzionalmente:166
- a.
- viola le limitazioni delle emissioni prescritte in virtù della presente legge (art. 12 e 34 cpv. 1);
- b.
- non si conforma alle decisioni di risanamento (art. 16 e 32c cpv. 1);
- c.
- non prende le misure di protezione acustica prescritte dall’autorità (art. 19–25);
- d.
- fornisce informazioni o istruzioni errate o incomplete (art. 27);
- e.
- utilizza sostanze, senza che siano accompagnate dalle necessarie informazioni o istruzioni, in modo tale che esse, i loro derivati o i loro rifiuti possono mettere in pericolo l’ambiente o indirettamente l’uomo (art. 28);
- f.
- incenerisce abusivamente rifiuti fuori degli impianti (art. 30c cpv. 2);
- g.
- deposita rifiuti fuori delle discariche autorizzate (art. 30e cpv. 1);
- h.
- viola l’obbligo di notifica concernente i rifiuti (art. 30f cpv. 4, 30g cpv. 2, 32b cpv. 2 e 3);
- i.
- viola le prescrizioni sui rifiuti (art. 30a lett. a e c, 30b, 30c cpv. 3, 30d, 30h cpv. 1, 32abis, 32b cpv. 4 e 32e cpv. 1–4);
- k.
- viola le prescrizioni sul traffico di altri rifiuti (art. 30g cpv. 1);
- l.
- non garantisce la copertura dei costi per la chiusura, gli interventi ulteriori e il risanamento della discarica (art. 32b cpv. 1);
- m.
- viola le prescrizioni sul deterioramento fisico e l’utilizzazione del suolo (art. 33 cpv. 2 e 34 cpv. 1 e 2) nonché sui provvedimenti atti a ridurre il deterioramento del suolo (art. 34 cpv. 3);
- mbis.167
- viola le prescrizioni sulla tracciabilità del legno e dei prodotti da esso derivati nonché di altre materie prime e prodotti designati dal Consiglio federale secondo l’articolo 35e capoverso 3 per i quali è stato introdotto un obbligo di documentazione (art. 35g cpv.1);
- n.
- viola le prescrizioni sulla messa in commercio di impianti fabbricati in serie168 (art. 40);
- o.
- rifiuta di dare informazioni o fornisce dati inesatti all’autorità competente (art. 46);169
- p.
- viola le prescrizioni sulla copertura della responsabilità civile (art. 59b).170
2 Se l’autore ha agito per negligenza, la pena è della multa.
3 Il tentativo e la complicità sono punibili.
Art. 61 Contraventions
1 Liable to a fine not exceeding 20,000 francs is any person who wilfully:163
- a.
- fails to comply with the limitations of emissions stipulated in this Act (Art. 12 and 34 para. 1);
- b.
- fails to comply with remediation orders (Art. 16 and 32c para. 1);
- c.
- fails to carry out officially ordered soundproofing measures (Art. 19–25);
- d.
- provides false or incomplete information or instructions (Art. 27);
- e.
- handles substances with no accompanying information or instructions in such a manner that they, their derivatives or waste may present a danger to the environment or indirectly endanger people (Art. 28);
- f.
- burns waste illegally outside installations (Art. 30c para. 2);
- g.
- deposits waste outside authorised landfills (Art. 30e para. 1);
- h.
- infringes the reporting duties in connection with waste (Art. 30f para. 4, 30g para. 2, 32b para. 2 and 3);
- i.
- infringes the regulations on waste (Art. 30a let. a and c, 30b, 30c para. 3, 30d, 30h para. 1, 32abis, 32b para. 4 and 32e para. 1–4);
- k.
- infringes the regulations on the movement of other forms of waste (Art. 30g para. 1);
- l.
- fails to guarantee coverage of the costs of closure, after-care and remediation of a landfill (Art. 32b para. 1);
- m.
- infringes the regulations on physical impacts on and the use of the soil (Art. 33 para. 2 and 34 para. 1 and 2) or on measures to reduce the soil pollution (Art. 34 para. 3);
- mbis.164
- infringes regulations on the traceability of timber and wood products and raw materials and products specified by the Federal Council pursuant to Article 35e paragraph 3 and for which a documentation requirement has been imposed (Art. 35g para. 1);
- n.
- infringes the regulations on placing series-produced installations165 on the market (Art. 40);
- o.
- refuses to provide information to the competent authority or provides incorrect information (Art. 46);
- p.166
- infringes the regulations on providing a guarantee for liability (Art. 59b).
2 If the offender acts negligently, the penalty is a fine.
