Art. 89 In generale

1 Se la competente autorità di vigilanza accerta una violazione del diritto:

a.
essa può esigere che la persona fisica o giuridica responsabile della violazione:
1.
vi ponga rimedio e prenda i provvedimenti necessari per evitare il ripetersi della violazione,
2.
la informi sulle misure prese,
3.
versi alla Confederazione i proventi conseguiti illecitamente;
b.
essa può chiedere al DATEC di completare con oneri la concessione, di limitarla, di sospenderla o di ritirarla.

2 Su proposta dell’Autorità di ricorso (art. 97 cpv. 4), il DATEC può vietare il programma o imporre oneri per la sua diffusione.90

Art. 89 General

1 If the supervisory authority establishes an infringement of the law, it may:

a.
require the natural or legal person responsible for the infringement:
1.
to remedy the deficiency and take measures to ensure that that the infringement does not recur,
2.
to inform the authority of the precautions taken,
3.
to surrender to the Confederation the revenue achieved as a result of the infringement;
b.
request DETEC to make the licence subject to conditions, or to restrict, suspend or withdraw the licence.

2 At the request of the Complaints Authority (Art. 97 para. 4), DETEC may ban the programme service or allow it only under certain conditions.92
