1 Ai fini dell’applicazione e dell’esecuzione del diritto fiscale svizzero l’AFC inoltra alle autorità fiscali interessate le informazioni che le sono state trasmesse spontaneamente da altri Stati. Segnala a tali autorità le restrizioni inerenti all’impiego delle informazioni trasmesse e l’obbligo di mantenere il segreto secondo le disposizioni in materia di assistenza amministrativa della convenzione applicabile.
2 Se la convenzione applicabile lo consente e il diritto svizzero lo prevede, l’AFC inoltra le informazioni che le sono state trasmesse spontaneamente da un altro Stato ad altre autorità svizzere per le quali tali informazioni sono interessanti. Se del caso, l’AFC chiede il consenso dell’autorità competente dello Stato che ha trasmesso le informazioni.
1 The FTA shall forward information that other states have spontaneously transmitted to it to the tax authorities interested in order to apply and enforce Swiss tax law. It shall notify them of the restrictions on the use of the transmitted information and of the confidentiality obligations under the administrative assistance provisions of the applicable agreement.
2 It shall forward the information spontaneously transmitted by another state to other Swiss authorities to which the information is of interest provided this is permitted under the applicable convention and provided for by Swiss law. If required, it shall obtain the consent of the competent authority in the requested state.
