Art. 7

¹ L’istituzione che riceve in prestito beni culturali deve presentare al Servizio specializzato una richiesta di rilascio di una garanzia di restituzione per uno o più beni culturali almeno tre mesi prima della prevista importazione in Svizzera.

² La richiesta deve indicare:

a.: il nome e l’indirizzo dell’istituzione che dà in prestito il bene culturale;
b.: la descrizione del bene culturale;
c.: la provenienza del bene culturale, nel modo più esatto possibile;
d.: la data prevista per l’importazione temporanea del bene culturale in Svizzera;
e.: la data prevista per l’esportazione del bene culturale dalla Svizzera;
f.: la durata dell’esposizione;
g.: la durata della garanzia di restituzione richiesta.

³La richiesta deve essere presentata in una lingua ufficiale. Le informazioni di cui al capoverso 2 lettere b e c devono essere trasmesse in forma elettronica. Le stesse possono essere fornite anche in inglese.

⁴ Alla richiesta deve essere allegato un estratto del contratto di prestito con l’istituzione che dà in prestito il bene culturale. Nell’estratto deve essere specificato che, al termine dell’esposizione in Svizzera o di una mostra itinerante attraverso più Paesi, il bene culturale è restituito allo Stato contraente che l’ha dato in prestito.

⁵ Se le indicazioni contenute nella richiesta sono lacunose o se manca l’estratto del contratto di prestito, il Servizio specializzato accorda all’istituzione che riceve in prestito beni culturali un termine di 10 giorni per conformarsi. Il termine è accompagnato dall’avvertenza che in caso di mancata completazione delle indicazioni richieste entro il termine stabilito o di mancata presentazione dell’estratto del contratto di prestito la domanda sarà respinta senza essere pubblicata (art. 11 cpv. 2 LTBC).

Art. 7

¹ The institution borrowing one or more items of cultural property must submit a request for the issue of a guarantee of return to the specialist service, at the latest three months before the intended import of the cultural property into Switzerland.

² The request must include the following information:

a.: name and address of the lending institution;
b.: a description of the cultural property;
c.: as precise a description as possible of the cultural property’s origin;
d.: the intended date of the temporary import of cultural property into Switzerland;
e.: the intended date of the export of the cultural property from Switzerland;
f.: the duration of the exhibition;
g.: the requested term of the guarantee of return.

³ The request must be submitted in an official language. The information specified in paragraph 2 letters b and c must be submitted in electronic form. This information may also be submitted in English.

⁴ A copy of the loan agreement with the lending institution must be enclosed with the request. The copy must indicate that the cultural property will return to the contracting state from which it was borrowed at the completion of the exhibition in Switzerland or at the completion of a travelling exhibition through multiple countries.

⁵ The specialist service shall allow the borrowing institution a period of 10 days to rectify incomplete requests or requests without a copy of the loan agreement. It shall combine the deadline with the warning that the request may be rejected without publication (Art. 11 para. 2 CPTA) if the request is not rectified within the deadline or a copy of the loan agreement is not submitted.
