1 Se una domanda inoltrata all’IPI non soddisfa le esigenze formali previste dalla LPM o dalla presente ordinanza o dal regolamento d’esecuzione del 18 gennaio 1996101 dell’Accordo di Madrid e del Protocollo di Madrid, o se le tasse prescritte non sono stati pagate, l’IPI impartisce al richiedente un termine per eliminare il difetto.102
2 Se il difetto non è eliminato entro il termine stabilito, la domanda è respinta. L’IPI può eccezionalmente impartire termini supplementari.

1 If an application filed with the IPI does not fulfil the formal requirements of the TmPA, this Ordinance or the Common Regulations to the Madrid Agreement of 18 January 1996103 and the Madrid Protocol, or if the prescribed fees are not paid, the IPI shall set the applicant a time limit to remedy the deficiency.104
2 If the applicant does not remedy the deficiency within the time limit, the IPI shall refuse the application. The IPI may set further time limits in exceptional cases.
