Art. 24a Forma e contenuto della domanda

La domanda di cancellazione di una registrazione per mancato uso del marchio deve essere presentata in due esemplari e contenere:

a.: il cognome e il nome o la ragione commerciale, l’indirizzo del richiedente ed eventualmente il suo recapito in Svizzera;
b.: il numero della registrazione di cui è chiesta la cancellazione e il nome o la ragione commerciale del titolare del marchio;
c.: una dichiarazione che precisi in che misura è chiesta la cancellazione;
d.: una motivazione della domanda di cancellazione, che renda in particolare verosimile il mancato uso;
e.: i mezzi di prova.

Art. 24a Form and content of the request

The request for cancellation of a trade mark registration on the grounds of non-use of the trade mark must be submitted in two copies and must include:

a.: the surname and first name or the company name, the address of the applicant and, where applicable, their address for service in Switzerland;
b.: the number of the trade mark registration for which a cancellation is requested, as well as the name or company of the proprietor of the trade mark;
c.: a declaration of the extent of the cancellation;
d.: an explanation of the request for cancellation which, in particular, substantiates the claim of non-use;
e.: evidence.
