Art. 111 Sistemi d’informazione per documenti di viaggio

¹ La SEM gestisce un sistema d’informazione per il rilascio a stranieri di documenti di viaggio svizzeri e permessi di ritorno (ISR).⁴²¹

² L’ISR contiene i dati seguenti:

a.⁴²²: cognome, nome, sesso, data e luogo di nascita, cittadinanza, indirizzo, statura, immagine del viso, impronte digitali, cognome e nome dei genitori, cognome dei genitori prima del matrimonio, firma, numero del fascicolo e numero personale;
b.: dati relativi alla domanda, quali data di presentazione e decisione;
c.: dati relativi al documento di viaggio, quali data di rilascio e durata di validità;
d.: firma e nome del rappresentante legale per documenti di viaggio rilasciati a minori o interdetti;
e.: cognome coniugale, nome religioso o nome d’arte e dati relativi a segni particolari quali disabilità, protesi o impianti, se il richiedente esige che tali dati figurino nel documento di viaggio;
f.: dati relativi ai documenti di viaggio persi.

³ Mediante interrogazione automatica nel sistema di ricerca informatizzato di polizia RIPOL si verifica se il richiedente è ricercato per un crimine o un delitto.

⁴ I dati registrati in virtù del capoverso 2 sono trattati dai collaboratori della SEM incaricati del rilascio di documenti di viaggio svizzeri e permessi di ritorno.⁴²³

⁵ La SEM può rendere accessibili i dati registrati in virtù del capoverso 2 alle seguenti autorità o servizi, mediante procedura di richiamo, sempreché tali autorità o servizi ne abbisognino per l’adempimento dei loro compiti:⁴²⁴

a.⁴²⁵: il servizio incaricato dell’allestimento dei documenti di viaggio;
b.: i posti di confine delle autorità cantonali di polizia e il Corpo delle guardie di confine, per l’esecuzione del controllo delle persone;
c.: i posti di polizia designati dai Cantoni, per l’identificazione delle persone e per la ricezione di notificazioni concernenti documenti di viaggio smarriti;
d.⁴²⁶: le autorità o i servizi designati dai Cantoni, per la ricezione delle domande di rilascio di documenti di viaggio;
e.⁴²⁷: le autorità o i servizi designati dai Cantoni, per la registrazione dell’immagine del viso e delle impronte digitali.

⁶ Il Consiglio federale emana le disposizioni d’esecuzione.

Art. 111 Information systems for travel documents

¹ SEM shall maintain an information system for the issue of Swiss travel documents and return visas to foreign nationals (the ISR) in accordance with Article 59.⁴⁰⁶

² The ISR shall contain the following data:

a.⁴⁰⁷: the surname, first name, sex, date of birth, place of birth, nationality, address, height, facial image, name and first name of parents, surnames of parents at birth, signature, file number and personal number;
b.: information on the application, such as the date of receipt of application and decision on the application;
c.: information on the travel document, such as the date of issue and term of validity;
d.: the signatures and names of the statutory representative in the case of travel documents issued to minors or incapacitated persons;
e.: combined surnames, religious names or pseudonyms as well as information on special characteristics such as disabilities, prostheses or implants provided the applicant requests that the travel document contain this information;
f.: information on lost travel documents.

³ To check whether an alert has been issued in respect of the applicant due to a felony or a misdemeanour, the RIPOL computerised search system automatically conducts a search.⁴⁰⁸

⁴ The data collected in accordance with paragraph 2 shall be processed by employees of SEM who deal with issuing Swiss travel documents and return visas.⁴⁰⁹

⁵ SEM may make the data that it has collected in accordance with paragraph 2 accessible to the following authorities or offices through a retrieval process, insofar as they need the data for the fulfilment of their duties:⁴¹⁰

a.: the office responsible for issuing travel documents;
b.: the border posts of the cantonal police authorities and the Border Guard, in order to carry out checks on persons;
c.: the police stations designated by the cantons to carry out checks on persons and to record reports of lost travel documents;
d.⁴¹¹: the authorities or agencies appointed by the cantons to accept applications for the issue of travel documents;
e.⁴¹²: the authorities or agencies appointed by the cantons to take portrait photographs or fingerprints
