Art. 165f Système d’information centralisé relatif aux flux d’éléments fertilisants

1 L’OFAG gère un système d’information pour l’enregistrement des flux d’éléments fertilisants dans l’agriculture.

2 Les exploitations qui cèdent des éléments fertilisants doivent enregistrer toutes les livraisons dans le système d’information.

3 Les exploitations qui prennent en charge des éléments fertilisants doivent confirmer toutes les livraisons dans le système d’information.

4 Dans le cadre de leurs tâches légales, les services et les personnes suivants peuvent accéder en ligne aux données enregistrées dans le système d’information:

a.
l’OFEV: pour soutenir l’exécution de la législation sur la protection des eaux;
b.
les autorités d’exécution cantonales et les organisations qu’elles ont mandatées pour effectuer des contrôles: pour accomplir les tâches relevant de leur domaine de compétence;
c.
l’exploitant concerné par ces données;
d.
les tiers qui disposent d’une procuration de l’exploitant.

Art. 165f Central information system for the movement of fertilisers

1 The FOAG operates an information system for recording the movement of fertilisers in agriculture.

2 Farms that provide fertiliser are obliged to record all deliveries in the information system.

3 Farms that receive fertiliser are obliged to record all deliveries in the information system.

4 As part of their legal obligations, the following agencies and individuals can download data from the information system:

a.
the FOAG: for support in implementing legislation on water protection;
b.
the cantonal executive authorities and agencies mandated by them to carry out checks: to fulfil their assigned tasks in the relevant area of responsibility;
c.
the farmer, for data that concerns him or her;
d.
third parties who have authorisation from the farmer.
