810.308 Ordinance of 20 September 2013 on Organisational Aspects of the Human Research Act (HRA Organisation Ordinance, OrgO-HRA)
Art. 4 Récusation
1 Les membres de la commission d’éthique se récusent, quand:
- a.
- ils prennent part eux-mêmes au projet de recherche ou que, pour d’autres raisons, ils y ont un intérêt personnel;
- b.
- des personnes auxquelles ils sont habilités à donner des instructions, aux ordres desquelles ils sont soumis ou avec lesquelles ils sont personnellement liés prennent part au projet de recherche, ou quand
- c.
- ils sont impliqués dans le projet pour d’autres raisons.
2 Les membres impliqués ne peuvent pas prendre part aux délibérations ni à la prise de décision concernant l’objet en question.
Art. 4 Withdrawal from participation
1 Members of the ethics committee shall withdraw from participation in cases where:
- a.
- they are personally involved, or otherwise have a personal interest, in the research project;
- b.
- persons reporting to them, to whom they report, or with whom they have close personal ties, are involved in the research project; or
- c.
- they are an interested party for other reasons.
2 Members who are interested parties must not participate in deliberations or in decision-making on the matter in question.
