810.21 Federal Act of 8 October 2004 on the Transplantation of Organs, Tissues and Cells (Transplantation Act)
Art. 46 Sûretés
Le Conseil fédéral peut, aux fins de protéger les personnes lésées:
- a.
- obliger les personnes qui mettent dans le commerce ou transplantent des organes, des tissus ou des cellules d’origine animale à s’assurer contre les coûts liés à leur responsabilité civile ou à produire d’autres sûretés;
- b.
- déterminer ces sûretés et en fixer la durée;
- c.
- obliger les personnes tenues de fournir des sûretés à communiquer à l’OFSP l’existence, la suspension ou la suppression des sûretés.
Art. 46 Indemnification
In order to protect harmed individuals, the Federal Council may:
- a.
- require any person who places on the market or transplants animal organs, tissues or cells to obtain insurance coverage for the costs for which he is liable or to make provision for another form of indemnification;
- b.
- determine the scope and duration of this indemnification;
- c.
- oblige the indemnifier to notify the FOPH of the existence, interruption or cessation of the indemnification.
