Art. 69e Tâches et compétences de l’organe de perception

1 L’organe de perception est habilité à rendre des décisions:

a.
par rapport aux assujettis à la redevance: sur l’assujettissement;
b.
par rapport aux cantons et aux communes: sur leur indemnisation selon l’art. 69g, al. 4.

2 L’organe de perception agit en tant qu’autorité au sens de l’art. 1, al. 2, let. e, PA63. En vertu de l’art. 79 de la loi fédérale du 11 avril 1889 sur la poursuite pour dettes et la faillite (LP)64, il peut procéder à la mainlevée de l’opposition dans les procédures de poursuite et constitue une autorité administrative au sens de l’art. 80, al. 2, ch. 2, LP.

3 Il ne peut pratiquer aucune autre activité économique en dehors des tâches que lui assigne la présente loi.

4 Il publie chaque année un rapport sur ses activités ainsi que ses comptes annuels.

Art. 69e Duties and powers of the collection agency

1 The collection agency may issue administrative rulings:

a.
to fee payers: on the obligation to pay;
b.
to the cantons and communes: on the payments made under Article 69g paragraph 4.

2 The collection agency acts as an authority as defined in Article 1 paragraph 2 letter e APA62. It may dismiss an objection in debt enforcement proceedings in accordance with Article 79 of the Federal Act of 11 April 188963 on Debt Enforcement and Bankruptcy (DEBA) and is deemed to be an administrative authority in terms of Article 80 paragraph 2 number 2 DEBA.

3 It may not pursue any economic activity other than that delegated to it under this Act.

4 Each year it shall publish a report on its activities and its annual accounts.
